Gore the Florida Supreme Court ruled unani mously Friday that Secretary of State Katherine Harris may not cer tify a winner in the states presiden tial election between Gore and IGeorge W Bush until further order of this A hearing was set for The court stepped in after Harris announced she intended to certify a winner today following the counting of overseas absentee bal lots Democrats want final vote cer tification detayed until all hand recounts are completed The high courts ruling super seded a ruling earlier Friday by Cir cuit Judge Terry Lewis who said Harris may reject handcounted votes tallied after the states Nov 14 deadline In another defeat for Republi cans a federal appeals court denied Bushs request to stop hand tallies The llth Circuit Court of Appeals said states have latitude in setting up elections and declined to get involved in the Florida dispute at least for now Broward Countys manual recount of ballots contin ued Friday after a circuitcourt judge refused a Republicans request to stop it Judge Leonard Stafford refused to end the recount saying GOP activist William Scherer had not demonstrated any emergency that would require immediate action A circuit final tally L By CHAKA FERGUSON The Associated Press ALBUQUERQUE Al Gore won a 481 vote squeaker Friday in New Mexico the closest presidential race in the coun try outside Florida after a series of clerical blunders and a flipflopped lead that kept the race in limbo for 10 days The call by The Associated Press is based on complete unofficial results each county said it gave to the secretary of state Each countys returns wont be made official until the state Canvassing Board meets Nov 28 In New Mexico Gore had votes and George W Bush had votes Besides Florida New Mexico had been the only state without a declared winner We believe every vote has been fairly and fully state Democratic Chairwoman Diane Denish said We expect on the 28th the results will be cer tified and New Mexico will be an Al Gore state Im very proud of Gore gains New Mexicos five electoral votes but the race was not likely to be decisive Whoever wins Floridas 2S elec toral votes has enough to declare victory New Mexico could come into play if Bush were to lose Florida and challenge results here and in a couple of other close states There is no automatic recount in New Mexico a candidate has to request it Bush emotional highs and lows for both cam paigns the llth Circuit Court of Appeals in Atlanta rejected Bushs request to halt the recounts returning the matter to Florida courts As aides watched glumly from Texas Bush adviser James A Baker III said neither court has yet to address the core of Bushs case that hand counts from selected counties are unfair and expose the election to mistakes and political mischief We remain confident the supreme court will find the sec retary of state properly exer cised her discretion in barring manual recounts he said Republican operatives were in each of Floridas 67 counties in case a statewide manual recount was ordered either by the courts or as a last resort by Bush himself Bush aides had been working behind the scenes to set up a victory statement
