magistrate ruled sion Tuesday that New Mexico tribes in a lawsuit over the legality of casino gambling wont have to produce documents outlining tribal representatives discus sions with state and federal offi cials Magistrate William Deaton ruled that the documents including minutes of tribal coun cil meetings are privileged Attorney John Kellys of fice had no comment on the deci BERNARD H MARKS Bernard H Marks 78 passed away March 27 1996 He was a former resident of Houston TX where he lived for 30 years He has lived in Santa Fe the past 14 years Mr Marks married Frances Marks May She preceded him in death March He sewed in the Navy as 2nd Lieutenant during WWII He graduated from University of Texas with a De gree in Engineering in 1941 He subse quently attended Cal Tech during his Naval service He was a longtime executive with Pangbom Corporation before his retire ment in 1981 Mr Marks belonged to SCORE New comers of Santa Fe and was a Past Pa tron of School of American Jerre Luikart Myers of Santa Fe who preceded him in death He married Marian Mimi Hubby of Santa Fe in 1970 prior marriage to Jane Ritch Dr Hubby was a graduate of the Uni versity of Texas where he received his in 1955 and in 1959 in Biol ogy After receiving his in Biology from the University of Texas in 1959 Dr Hubby went to the University of Chi cago as postdoctoral fellow where he became a full professor in 1970 His experimental expertise along with the insight of Dr Richard Lewontin in the area of theoretical population ge Kelly is the defendant in the lawsuit brought earlier this year by eight gambling tribes who asked federal courts to declare tribal casinos legal The state Su preme Court has ruled the casi nos are illegal The federal case is expected to go to trial before Judge Martha Vazquez this summer Tribes already have produced thousands of documents relat ing to their bingo hall and casino operations including some finan cial records Santa Ana attorney Richard Hughes said Many of the records are protected by a temporary confidentiality order Hughes said tribes will ask the courts to extend the order de spite objections from Kelly Most of the financial records date
