Justice Ritchie yesterday delivered judgment on the application for a writ of Hareas Corpus to enquire into the legality of the detention of Louig Piaget. Lordship thought the statements were duly authenticated and tie was unable to pay there was no evidence before him that an offence had been committed on the ground that the crime was not sufficiently stated in the warrant. The warrant was in the form prescribed by the act and the papers were Good. Another ground taken waa that the offence As shown by the depositions etc., was if an offence at All larceny and embezzlement. Al though from the evidence before his lordship he was inclined to think that the offence with which the per son is charged is larceny the line dividing these crimes is so Fine that it is difficult to say before the evidence is Given in the trial whether the crime is larceny or embezzlement. There could be no doubt that if a person were charged with embezzle ment in Canada and the evidence disclosed a larceny Only the Magis trate would be justified in committing him for trial. He saw no ground for discharging the prisoner and there fore dismissed the summons. C. A. Smith attorney for the prisoner obtained a summons from judge Ritchie last evening which is returnable before judge Weatherbe at Windsor today.
