The front door of the House was locked and the Back door closed and latched. The Latch however could be easily raised from the outside through an aperture. About 2 of clock of the night of the burglary according to the record two men of whom Appellant was one went up the Back Steps add upon this Levy arose from the bed and after shaking Hyatt his tied fellow As of to arouse him went into the House through the Back door the two men following him. It is Plain from the record that Hyatt had no share in the burglary and equally Plain that there was a conspiracy bet Ween i Evy and the two who entered the Bouse with him. It should be borne constantly in mind that Levy occupied the relation of servant to Wing and that it was he who lifted the Latch and led the Way into the House. The charge of the court hinged the appellants guilt upon an entry effected by fraud ignoring Force altogether. To warrant conviction upon a charge of Burgl Arious entry effected by fraud the fraud or deceit must be practice upon the occupant and must be the Means used to induce him to give admittance. Here authorities Are cited in support of this opinion under the statute of the entry is by fraudulent trick or device whether practice upon the occupant or a servant authorized to give entry it would be Burg Larous. It is Plain that the servant Levy was not induced to open the door by fraud or deceit that he was not the dupe but the willing coadjutor of bus fellow conspirators. And also that the entry was not effected by the exercise of similar arts upon Wing the occupant and owner. This being so the court below erred in instructing the jury upon a Case made by that character of evidence and for this reason a new trial should have been granted. The statute provides that in order to convict a servant of a Burgl Arious entry into the premises of hts employer the breaking must be actual and not constructive. From this it May be argued that since Levy the servant did not enter by an annal breaking he can not be convicted and of consequence that bus associates can not. This immunity however Given by the Law to i Evy As a result of bus relation As servant would not extend to his associates since his constructive breaking would if committed by a person other than a servant be Burgl Arious and Levy a breaking being in pursuance of a common design would he Burgl Arious in his confederates even though not punishable As to him this conclusion being a necessary sequence from the doctrine of separate responsibility in cases of conspiracy. In Legal contemplation there is no crime without a principal and if Levy stands in a relation to the occupant of the premises which relieves him from the situation of a principal offender the Law will look for a head to the co conspirators who act through him in affecting the entry. To that in any event whether Levy can be convicted or not if the facts be proved by credible testimony there is no escape for those who acted with him. But it is not True in Law As has been conceded for the purpose of argument that the facts being admitted the breaking must be actual to warrant a conviction of the servant Levy had he acted alone the Law would have required proof of actual breaking to Render it Burgl Arious but not so when he confederated with others to commit the offence. Where the breaking is on conspiracy and a servant gives entry to his co Oonsa orators by a constructive breaking such As the opening of a door or the raising of a window their entry is by relation his entry and their crime his crime and All Are principal offenders.
