Iowa met in special session in the Council Chambers m said town on the third Day of August 1938, on Call of the mayor for the purpose of considering Street improvement matters. The mayor called the meeting order at 12 35 o clock p. A and the Roll Call showed the following be present mayor c. C. Sander councilmen Earl Abernethy or. H. D. Cole f. J. Miller. J. A. Schroeder f. C. Ruckdaschel. The town clerk announced that Lloyd Walter civil Engineer Postville Iowa had placed on file a preliminary plat and schedule of assessment As required by Section 5993 of the 1935 code of Iowa together with other data required by said Section All concerning and applying a certain proposed Street improvement program upon which said Engineer had heretofore been employed by said town. After discussion of the documents As filed including estimates of Cost plats schedules of assessment etc., councilman f. J. Miller introduced the following Resolution of necessity for the Street improvement together with a heading for the official publication for the same and moved that the same be proposed by this Council and that the Council meet at 7 30 o clock p. M. On the 29th Day of August. 1938, for the purpose of hearing objections said improvement and the adoption of said Resolution As proposed or As then amended and further that the clerk be and is hereby instructed publish said notice and Resolution in accordance with the Law by two publications in the Postville Herald. This motion was seconded by councilman Earl Abernethy. The mayor ordered the Roll called unon the passage of the motion with the following results yeas Earl Abernethy. Or. H. D. Cole. F. J. Miller. To whom it May concern and All persons interested notice is hereby Given that at a meeting of the town Council of the incorporated town of Postville. Iowa held on the third Day of August 1938, there was introduced and placed on file the Resolution of necessity hereinafter set Forth which Resolution will be considered for adoption by the town Council of said town at a meeting be held in the Council Chambers in said town at 7 30 o clock p. A. August 29, 1938. At which time and place the owners of property subject assessment for the Cost of the improvement contemplated by said Resolution May appear and make objection if any they have the contemplated improvement and the adoption of said Resolution at which time said Resolution May be amended and adopted or adopted As proposed. Notice is further Given that there is on file in the office of the town clerk a copy of the proposed Resolution of necessity a plat and schedule showing the streets be improved the proposed Width of the improvement each lot or part of lot proposed be assessed together with the valuation of the same As fixed by the Council an estimate of Cost of the proposed improvement and the kind of material be used and the amount which is estimated be assessed against each lot part of lot or parcel of ground.
