Mountain Democrat (Newspaper) - April 21, 1990, Placerville, California weekly news summary felony counts filed against Speedway operator Auburn the operators of the Placerville Speedway at the Al Dorado county Fairgrounds have been charged with nearly 100 Crimi Nal counts regarding their employment practices. Placer county District attorney John e. Shelley announced May 17 the filing of a 98-count complaint against John i. Padjen and Roberta a. Padjen who live in Roseville for suspected violations of the Cali fornia unemployment insurance code and the California Revenue and taxation code. The pad ens have been charged with 72 felony counts and 26 Mise Meanor counts alleging the couple failed to file employment tax returns for California employment insurance disability insurance and personal income taxes and failed to report corporate tax returns for 1987 and 1988. The complaint follows a nine month investigation by employment development department agents of the tax enforcement Section into the operation of the Padjen s Roseville based businesses including Padwell inc., Padjen productions and Padjen promotions. The pad ens operate two speedways outside of Placer county Sil ver Dollar Speedway in Chico and Placerville Speedway. Records seized revealed that the Padjen businesses employed approximately 300 part time employees. The employees were paid in excess of with an accrued tax liability of nearly in unemployment insurance disability insurance and personal income taxes that were not withheld or paid to the state. The million is million More than what Pacific Bell proposed paying Back in August 1989, when the phone company negotiated with the state Public utilities commission. Those negotiations were the re suit of a class action complaint filed by Sawaya although the Puc Dis missed the class action complaint it nonetheless negotiated with Pacific Bell in closed sessions and reached the million settlement. The refunds will go to Pacific Bell customers in Rural areas that were or still Are served by older equipment that cannot deliver the rapid service of modernized switching equipment. Sawaya began his Battle in 1985 after he paid a introductory fee and a per month charge for Pacific Bell s touch tone Telephone service which the company advertised As being a system capable of making speedier connections. But Sawaya said he became aware that the service was not any faster than what he had before and eventually it became known that Pollock Pines customers were serviced by an older step by step system. That system was changed in 1988, and the newer equipment now serves the area. The Only step by step equipment left in Al Dorado county serves customers in Kyburz prefix of 293 and South Lake Tahoe customers with the prefix of 639, according to Dave Miller Pacific Bell spokes Man. We re reluctant to comment on the Puc s action because we have not yet seen the actual Miller said. We proposed a million refund and we believe that is More than fair. We Don t believe a million refund is justified. The fact is All customers who requested touch tone service received it exactly As approved by the Puc regardless of whether they were served by Central offices using electronic or older step Miller added. We offered a million refund because our product brochure May have inadvertently confused some of those customers about the Speed of touch tone. We did not intend to confuse anyone. We offered the refund As a Good will gesture to our in a press release issued Friday by Pacific Bell it was reported that residential and business touch tone customers who still Are served by the older step by step equipment will no longer be charged for the ser vice because of the Puc s order. As the remaining 125 step by step Central offices statewide Are gradually made electronic which the phone company expects to accomplish by the end of 1991, residential customers served by the offices that Are modernized will not be charged for touch tone service according to the press release. The million in refunds for former customers or credits for cur rent customers that the Puc ordered Pacific Bell to pay will cover payments made since May 1987. Miller last August told the Democrat he estimates customers affected by the order will receive an average of but that was when the figure was anticipated to be s5 million not million so the re fund or credit figure May be higher. The Puc order affects approximately residential and Busi Ness customers statewide primarily in Northern California according to Miller. Pacific Bell will Send those customers a notice soon explaining the order and telling them How much their refund or credit will be. It is expected the credit or refund will be applied in August. Pacific Bell currently charges residential customers a month to have touch tone service. While the Puc s action announced Friday eliminates the charge for customers served by step by step Central offices Puc officials anticipate that within the year charges for touch tone for All residential customers and possibly business customers As Well who Are served by electronic Central offices will be eliminated according to the press release from Pacific Bell.
