Be it enacted by the general Assembly the skate Ohio that when husband Aud wife Are living separate and apart from each other Are divorced Aud the question As to the care custody and control the offspring their marriage is brought before any court competent Juri diction in this , that the father Aud Mother said children shall stand upon an Equality before the courts As to the care eur Tody and control said offspring so far As it relates to their being a Ither father Mother said children. That the court up in hearing the testimony either both Eaid parents corroborated by other proof shall decide which one them shall Haye the care custody and control such offspring taking into account that which would be for the Best me rests said children. Provided such children be eight years age More they be allowed to choose which Parent they Piefer to live with unless such Parent so selected by said children be unfitted to take charge said children by Rea son moral depravity habitual drunkenness incapacity then said court shall determine the custodian such children. If upon such hearing it should be proven to the Couit that both parents Are improper persons to have the care custody and control such children the court May in it discretion either designate some reputable and discreet person to take charge said children May commit them to a county District children a Home in which they their parents have a 1 Gal settlement. The court May order Faith both parents to support to help support said children no matter who be their custodian.
