Lawrence county common pleas court judge Ralph d. Pratt yesterday gave attorney Shawn a. Sensky five Days to respond to new matters raised yesterday by the City. The City in turn will have 10 Days to file a counter response. Pratt was asked to Grant an injunction that would in effect repeal an ordinance that requires landlords to pay a fee Register their rental property and open them to a City code enforcement inspector. He was also asked to dismiss the request of the Edinburg landlord who owns 13 rental properties within new Castle limits. The court proceedings have caused the City to Lay off housing inspector Joseph scrim whose salary was to be partly funded through the fees raised from the ordinance. In a non july trial Pratt yesterday heard the request of landlord Brian Simpson of 124 Edinburg Road represented by Sensky. Simpson claiming his constitutional rights will be violated by the City a ordinance has requested a permanent injunction that would repeal a building and housing code ordinance adopted by new Castle City Council on april 9, and signed by mayor Tim Fulkerson on april 13. It was to have become effective on May 4. In april Pratt granted Simpsons request for a temporary injunction which has prohibited the City from enforcing the ordinance. New Castle solicitor James Manolis yesterday challenged Simpsons claims. The Only factual Issue presented that can be decided he said is if the inspection fee to be collected from the landlords is a tax or a License fee. He asked that the rest be dismissed. Manolis argued that when a legislative body such As Council enacts an ordinance a there is a presumption the the body acted in Good Faith a and that the ordinance a which is based on the Boca National property maintenance code a is constitutional and allows code officials Access to rental prop erty to make safety inspections. Manolis said Simpson has no standing to argue that the ordinance violates his constitutional Protection against unusual search and seizure. A landlord he said can not claim his privacy is being violated if Access is being sought to the Home of his tenant. Nor can he be held criminally responsible if a tenant refuses to allow the City code officer into his apartment to make an inspection. If Access is denied by the tenant Manolis said the code officer May obtain a warrant from a District Justice to inspect the premises. He added that the ordinance does not hinder a landlords ability to rent property. Although the landlord is required to comply by paying an inspection fee if he plans to rent property the fee is not collected until the inspection is completed. In code violations Are observed the landlord will be notified to Correct them but May Appeal the notice to a housing Board or the common pleas court he said. As to complaints that the ordinance is contradictory or vague Manolis argued that portions cited As contradictory had been part of an earlier ordinance that was repealed in 1985.
