New Braunfels Herald Zeitung (Newspaper) - September 26, 1997, New Braunfels, Texas g Friday,September ith a plea ARLINGTON, Va. (AP) — It was a confident, almost defiant Mary Albert who strode up to the microphones outside the Arlington County Courthouse in the spring and predicted: “I will be proven innocent atrial.” That was before his longtime mistress sobbed on the witness stand and described how Albert violently bit her and forced her to perform oral sex. It was before another woman testified that she, too, had been bitten by Albert in a sexual attack. That was before millions of television sports viewers learned of his penchant for wearing women's underwear and for pornographic movies and three-way sex. Inside that same courthouse Thursday, the bravado was gone, the booming sportscasters voice barely audible when Albert pleaded guilty to assault and battery, ending the trial that threw a spotlight on his kinky sex life — and left his broadcasting career in tatters. “I just felt like I had to end this ordeal for myself, my wonderful family, my fiancee. Heather, my friends and supporters," Albert said outside court in a weary voice. Hours after he pleaded guilty, NBC fired him. News Briefs CAPE CANAVERAL, Fla. (AP) — After winning an eleventh-hour approval, space shuttle Atlantis and David Wolf, the next American to live on Mir, dashed after the battered space station today for a weekend linkup. "I hope David remembered his screwdriver to help fix Mir," the astronaut's mom, Dome Wolf, said moments after Thursday night's liftoff. NASA Administrator Daniel Goldin announced his controversial decision to send Wolf on a four-month Mir mission after mulling over station safety reports. Then he flew down from Washington for the astronaut's night-tumed-into-day departure "Your son is unbelievable," Goldin told Mrs. Wolf. The guflg*D astronaut told his boss just before the flight, "I thought I was going to go on anyhow and I wouldn’t even need your answer." "I was very sure that it would be a go," Mrs. Wolf said, “but my only problem was that I almost didn’t sign his permission slip." DALLAS (AP) — A Southwest Airlines jet had to take evasive action when a business jet turned into its path 2,500 feet over downtown Dallas, according to Federal Aviation Administration officials. "It was close," said Doug Murphy, rn traffic division manager A.M UAM ALBERT Albert, 56, pleaded guilty to a misdemeanour charge for biting the woman, winch could send him to jail for a year and cost him $2,500 in fines at sentencing Oct 24. In exchange for his plea, prosecutors dropped the felony charge of forcible sodomy, which auld have sent Albeit to prison for life. Albeit was accused of flinging the woman onto a bed, viciously biting her and forcing her to perform oral sex in an Arlington hotel room Feb. 12 for failing ti) bring another man into their bed. for the FAA’s Southwest Region. Authorities said Flight 858 from San Antonio was on final approach to Dallas Love Field at 7 55 a rn Thursday when a Lear 35 turned slightly less than a mile in front of it. The jet went into a sudden climb after a collision warning sounded on the Southwest Boeing 737. An investigation has been launched by the FAA Murphy said. A preliminary report indicated that the controller who was in charge of both airplanes “may have forgotten the Southwest jet was there.” he said. The Brooklyn native, who for three decades has been one of America's most distinctive sports voices with his exuberant "Yesss!" call, had been allowed to continue as NBC's play-by-play man after the May indictment. Outside'court. Albert thanked NBC for standing by him. Less than four hours later, the network issued a statement saying it only stood by Albert because he gave assurances the charges were untrue. "Today, given Mr. Albert’s plea ... NBC terminates its relationship with Marv Albert.” Albert later resigned from the regional MSG cable network as the voice of basketball’s New York Knkks. His plea came a day after a surprise witness came forward with similar accusations: that Albert — wearing white panties and a garter belt — bit her on the neck and tried to force her to perform oral sex on him during a 1994 struggle in a Dallas hotel room that left her holding his toupee. "The significance of that testimony is profound," said Arlington County Commonweal!!) s Attorney Richard Trodden, adding the deal was endorsed by Albert’s 42-year-old accuser. mm of force AUSTIN (AP) — A state agency has begun a months-long process to require counties to draft formal policies on the use offbrce against jail inmates. But four of the Texas Jail Standards Commission's nine members say such a requirement wouldn’t have prevented alleged abuses videotaped more than a year ago at a county jail in Brazona County That jail is run by Capital Correctional Resources, Inc., a Jackson. Mississippi-based private prison company "Another written policy is not going to prevent something like this," Camelia Jones, a jail standards commission member and the Armstrong County sheriff, said during a commission meeting Thursday. AUSTIN (AP) — The federal judge presiding over Texas’ $14 billion lawsuit against the tobacco industry is being urged not to impose a sweeping gag order that could silence lawyers and others involved in the upcoming trial "Fundamentally, such an order would significantly impede the ability of the citizens of Texas to observe the actions of their government in this case." argued lawyers for Dow Jones & Co., publisher of The Wall Street Journal. The Dallas Morning News on Wednesday filed arguments against the proposed gag order and attorney Paul Wader said he expected to file more on Friday on behalf of The New Yori^Iunes and the Los Angeles Tutees, In addition, attorneys for both die tobacco industry and the state are objecting to the order MCALLEN. Texas (AP) — Three ex-lawmen accused of taking bribes to help drug traffickers smuggle marijuana are free on bond today after they were admonished against threatening anyone associated with the case. The stiff warning was issued Thursday by federal magistrates after prosecutor Terry Leonard disclosed he had videotapes in which one suspect discusses “past violence that he’s committed. "It was a much different plea than was offered today," Black said on CNN’s “Larry King Live." The defense team wanted to present evidence showing that Albert’s accuser staged a suicide'attempt, feigned a pregnancy and sought revenge against a boyfriend who dumped-her, and made up as much as 90 percent of the defense, the lawyer said* "I feel this is the best way for Marv to end this matter, and after much discussion Marv agreed to take my advice,’’ Black said. During three days of explicit testimony, Albert's 42-year-old accuser recounted a 10-year affair where he often asked her to bring along women’s underwear for him to wear, or for men to participate in three-way sex. Her credibility was undermined when Black played an audio tape Tuesday that seemed to catch her bribing a potential witness against Albert. The woman said that what sanded like a bribe was just a joke, though outside of court on Thursday the witness, cab driver Walter "Biggie" Brodie, said he considered the ofter real. But the tide turned Wednesday when Circuit Judge Benjamin NA. Kendrick allowed a second woman to tell her story Patricia Masden gave a matter-of-fect account how Albert bit her on the .lip in a Miami hotel room in 1993 and asked her to find a man for a sexual threesome. Then she told the story that buried Albert — an attack remarkably similar to the account given by Albert’s accuser that Albert called her to his Dallas hotel room in 1994 and, wearing only white panties and a garter belt, confronted her. He nibbed against her, saying he was tense and “needed some relief," she said. Then he bit her neck and tried to push her head toward his crotch and give him oral sex. In a struggle, she grabbed has hairpiece and pulled. "His hair lifted off and he immediately put his hands on his hair," she said. Three rows of Albert’s supporters — his fiancee and his daughter included — sat calmly, grimly in the courtroom, hearing tile humiliating account. In a statement, Albert said he would try to rebuild his personal and professional lives. "Don’t count Marv out,’’ said defense attorney Peter Greenspun. "He’s going to be back. " Bridging the Gap...
