There will be a Graveside Service at Guadalupe Valley Memorial Park on Monday, March 7, 2011 at I p. m. fol- By Greg Bowen The Herald-Zeitung District Judge Charles Ramsay has ruled that he has jurisdiction to hear the legal battle that has arisen over the city’s South Tributary Flood Control Project. Assistant City Attorney Paul Isham said the city is considering appealing the judge’s ruling to the 3rd Court of Appeals in Austin. The question of whether Ramsay’s New Braunfels court has jurisdiction, or the legal authority to hear the case, was raised by the city, which claimed that, as a governmental entity, it enjoyed immunity from the lawsuit. The suit was filed Nov. 3 by Carowest Land Inc., which is now completing the eastern leg of the $4.37 million drainage project. Defendants are the city and its project contractor, Yan-tis Co. of San Antonio. Carowest, which is owned in part by the Weston family of New Braunfels, is asking the court to rule it doesn’t have to pay the estimated more than $250,000 in delay damages being sought from the city by Yantis. The city’s position is that Carowest is contractually obligated to pay those damages. The city had sought to have City Manager Mike Morrison granted immunity from being called as a witness, a request lowed by a Memorial Service, also on Monday, March 7, 2011 at 2 p. m. at the Eden Hills Chapel. ZOELLER FUNERAL HOME Funerals & Cremations ¡Pt Dignity 615 Linda, New' Braunfels (830) 625-2349 the judge also overruled. “We weren’t trying to keep him out of the discussion,” Isham said. "We were saying that the plea to the jurisdiction could be decided by the court without the necessity of Mike Morrison testifying.” Isham said it is likely, if the case is not settled out of court, that Morrison would be asked to give a deposition and to testify as a witness. Yantis began work on the city’s South 1 rib project in January 2(X)9. Carowest owns the former Owens C hming plant site over which the easternmost portion of the project stretches. In September 2009, the city agreed to remove that portion from Yan-ta’s contract and to give Carowest control over construction there, according to the suit. Along the way, Carowest agreed to pay claims that might be brought against the city by Yantis, and Yantis agreed not to seek additional compensation for delays resulting from Can jw-est’s involvement. But in July 2010, Yantis filed a claim with the city seeking “delay damages” related to the project on the Carowest property. The city then submitted Yantis’ claim to Carowest and demanded Carowest pay to settle the claim. Carowest is asking the court to rule that Yantis has no right to damages. NASA RESEARCH SATELLITE PLUNGES INTO THE SEA WASHINGTON (AP) — For the second time in two years, a rocket glitch sent a NASA global warming satellite to the bottom of the sea Friday, a $424 million debacle that couldn't have come at a worse time for the space agency and its efforts to understand climate change. Years of belt-tightening have left NASA's Earth-watching system in sorry shape, according to many scientists. And any money for new environmental satellites will have to survive budget-cutting.
