The judge made it clear Tuesday he is not happy with the letter he characterized as an “ultimatum.” It sets an August deadline for the county to begin paying the justices for weekend duties and outlines the terms under which the justices would continue to perform magistrates. It includes no stated threat to quit, though. “If the court approves any kind of cost-of-living allowance in the budget cycle, they will certainly be included. However, its not the practice of this court to make exceptions for someone because they think they’re working too hard,” Scheel said. The letter mentions that the county now pays a magistrate to work weekdays in the jail and states it is unfair not to pay the JPs tx) work weekends. It is the second such letter Scheel has received. The county has sought leg islation to create a jail magistrate’s position because of concerns Schroeder and Campos expressed in January. They said the job had grown to the point it interfered with their regular duties. They asked for a raise of $5,OCX) a year “for magistrate, because they felt it was not part of their duty,” Scheel said. “We went to the Legisla ture and relieved them of the [magistrationj duties so they could handle regular business,” he said. “My opinion is that anyone who runs for public office does so on a voluntary basis Anytime they feel that their worth is more Subscribe! Campos said the issue is more complex. She claims the code of criminal procedure sets out which public officials are magistrates. Included are district and county court judges and other officials. “As I took my judicial training, gradually I realized that, no, it wasn’t solely the duty of the justice of the peace. I wasn’t any more responsible to magistrate than the district judge or the county court-at-law judge,” Campos said. When she took office in 1995, Campos said she and another JP did most magis-trations. They were paid $2,000 a year. Some days, her services wouldn’t be needled at fill. On a husy day, she might see two or three prisoners. Gradually, t he job has grown to be a daily task — particularly in the wake of Senate Bill 7, which guarantees prisoners a speedy hearing before a judge. “My colleagues are sometimes seeing 20 to 30 people a day,” Campos said. Beginning in January, she said, Scheel cut the $2,OOO compensation from t he budget. “At that time, I said it’s not solely the JPs’ responsibility to do this duty, number one; and, number two, I don’t feel we should do this without being compensated.
