New Braunfels firefighters responded to a report of a small grass fire about 5:30 p.m. along Old Bastrop Road north of the city, parallel to Interstate 35. They arrived on scene to find the fire had spread into a long pile of creosote-soaked old utility poles and railroad ties on a lot used by Living Earth Technology Corp. to store mulch and other landscaping products. By Jo Lee Ferguson Staff Writer The Texas Department of Transportation wants to know if you have a problem with Interstate 35 construction. Greg Malatek, area engineer for the Texas Department of Transportation, urged residents and business owners at a road work meeting Wednesday not to hesitate to call if they notice problem areas, like getting in and out of driveways. “We’ll do everything we can to try to make it a little bit better,” he said. “That’s y’all’s bread and butter.” Or if a business hears a pattern of complaints from customers, Malatek said the business should contact the local TxDOT office. “Again, we don’t want to affect y’all’s businesses. We want y’all to thrive,” he said. Malatek said residents also should call if they have suggestions. “We’re w illing to listen to any kind of suggestion,” he said. Traffic snarls will be a common occurrence in New Braunfels for a long time until the Texas Department of Transportation finishes construction on the busy highway. Committees of the Greater New Braunfels Chamber of Commerce. Three sections of Interstate 35 through New Braunfels are under construction: from south of Solms Road to a quarter mile north of Ruekle Road; from a quarter mile north of Ruekle Road to a half-mile north of Walnut Avenue; and from a half mile north of Walnut Avenue and a half-mile south of Texas 46. Dean Word Company is in charge of the first two segments and Deavers Construction is overseeing work on the third segment. Interstate 35 from south of Solms Road to a half-mile north of Walnut Avenue should be See TxDOT/7A Brookshire Homes hopes to get approval tonight to continue work on a southwest New Braunfels housing development. The city’s zoning board of adjustment will conduct a public hearing at 6:30 p.m. today on Brookshire’s appeal of the city’s decision to stop the company’s work in the Meadow Creek subdivision. The board meets in the council chambers at the New Braunfels Municipal Building, 424 S. Casted Ave. “We’re hoping that (tonight) will be a very good exchange between Brookshire Homes and the board of adjustment,” said T.J. Connolly, spokesman for Brookshire Homes. Earlier this year, the city issued permits to Brookshire Homes to build in the Meadow Creek subdivision off Pahmeyer Drive. However, the city later issued stop work orders for four homes and denied permits for other homes Brookshire planned to build. The city said the homes violated city ordinance because they were not the same “average value, construction, type and size as the established property in the area.” The city’s action came after Meadow Creek residents Greg and Gerry Williams submitted a letter and petition with 80 signatures protesting Brookshire’s development. They said it would significantly decrease their property values. The Williamses built a $ 115,000 home on one of the lots they own in the Meadow Creek subdivision. Brookshire Homes, a San Antonio developer, then bought die remaining 60 lots in the subdivision after the original developer of the subdivision amended the deed restrictions. Brookshire filed a lawsuit in the 274th District Court, claiming that the city’s code of ordinances “is unconstitutionally, vague, ambiguous and indefinite.” The lawsuit asks for Brookshire to be awarded K. Brookshire also appealed the city’s decision to the zoning board of adjustment, which allowed the company to receive additional building permits for the Meadow Creek subdivision. Brookshire Homes had a meeting Monday to which Meadow Creek neighbors and future residents were invited. Brookshire Homes President Greg Barrineau said it was important the meeting take place before the board of adjustment met, Connolly said. “Greg Barrineau felt it was important that Brookshire Homes reach out to the surrounding community and tell the Brookshire story,” Connolly said. Brookshire Homes has had many successful projects in San Antonio, and Barrineau believes the Meadow Creek project has been “terribly mislabeled and mis-characterized” by city officials, Connolly said. Brookshire sent out 1,350 invitations to the meeting he said. About 20 future Meadow Creek residents and another 50 to 75 neighbors of the project attended the meeting. “It was a really interesting two-hour exchange (Monday) night of neighbors talking to neighbors and a new development meeting each other as a community,” Connolly said. “It was in many ways a very See BROOKSHIRE/7A Longtime Comal teacher Elna Frazier passes away From staff reports Longtime teacher Elna Brittain Frazier passed away Tuesday. Frazier had moved to Waco in 1999 where she passed away at the Ridgecrest Retirement Center at the age of 95. Bom June IO, 1905, Frazier taught first grade for 44 years, most in Comal Independent School District. “Frazier Elementary school was named after her which is unusual because they usually don’t name schools after someone who is living,” former student and Comal school trustee Dora Gonzales said. The property will be used to build a new 800-student elementary school officials expect to open in the fall of 2002. “We’ve approved for the administration to go ahead with pursuing the purchase of that property,” school board president John Clay said. “We’ve been looking at it for a number of months and had to get some things worked out, but we’re really excited. It’s a wonderful piece of property.” CISD Superintendent Dr. Jerry Major said the property was south of Cibolo creek, about half a mile west of U.S. 281 along the new Overlook Parkway. It will sell to the district for about $300,000, Major said. “It’ll basically serve kiddos south of the Cibolo Creek in the Timberwood Park and Country Place subdivisions.” Timberwood Park is west of U.S. 281; Country Place is east of it. MAJOR The district’s architect, Pfluger and Associates of Austin, assured the CISD the property would be fairly easy to develop for an elementary school. CISD will hook the new school up to the San Antonio Water System (SAWS) and municipal sewer service. “Even though the land was more expensive than we would have liked, the fact that we don’t have to build a septic and water system was a real savings,” Major said.
