attorney acts as an adviser to the commission, which can overrule his recommendations. There have been two ethics hearings in the last two years.
Zech guided the ethics commission through the draft ordinance, explaining the “whats” and “whys” line-by-line and pertinent points of civil and administrative procedures.
The effort is an attempt to define formerly unspecified procedures.
One revision requires the city attorney to prepare a “probable cause report.”
“I felt some sort of report should be given so that you all have something in your hand dealing with the facts, and that wasn’t in previously,” Zech told commissioners.
“This way, you can understand where the city attorney is coming from in respect to his thought process and the law.” Another revision detailed the process of informally handling an ethics complaint.
Many revisions were clarifications or eliminations of redundancies.

The draft ordinance is still a work in progress. The commission might revisit the proposed ordinance
again or present it to council
The commission also voiced concern that they have not received appropriate information from legal counsel in the past.
The present ethics ordinance gives no guidance to the city attorney and did not define specific processes for ethics complaints.
“What we’re trying to do is establish some definitive, uniform guidelines, so no matter what city attorney is in charge, the process is the same every single time,” Zech said.
