faith in turning over documents in the Branch Davidian civil suit and a Waco court shouldnt penalize them In a filing Monday in federal court Justice Department attorney Marie Louise Hagen said the goy ernment opposes a sanc tion requested by lawyers for sur viving Branch Davidians who have sued the government for wrongful death She said plaintiffs attorneys caused part of the delay in turning over evidence by insisting on tak ing 24 depositions in December which took government employ ees away from document produc tion The plaintiffs asked District Judge Walter Smith to fine the government two weeks ago alleging Justice Department lawyers would delay the surrender of thousands of documents until shortly before a courtimposed deadline last week Lead plaintiffs attorney el Caddell had said he a lastminute document dump that would slow his prepa ration for the trials scheduled start in midMay Ms Hagen said in Mondays fil ing that most documents were sent to plaintiffs before the deadline including 51 boxes of materials sent the final weekend The motion for sanctions was filed before the date set by the Court for completion of document production and should be denied as she wrote The government sent some materials after the deadline Ms Hagen said thousands of pages of Department of Defense docu ments along with photos from various agencies still must be declassified before being turned over The deadly standoff near Waco began Feb 28 1993 when federal agents raided the rural home of Branch Davidian leader David Koresh and his followers Four agents and six sect members died in the gun battle Federal officials insist govern ment forces fired no shots when the sevenweek siege ended in an inferno Koresh and some 80 fol lowers perished during the blaze some from the fire others from gunshot wounds The government says the Davidians died by their own hands Victims in San Antonio plane crash identified SAN ANTONIO AP The names of the two men who died in a small plane crash Saturday in San Antonio were released Monday The victims were Gerald Babb 53 and Sidhartha Maitra 50 San Antonio Airport spokes woman Lisa BurkhardtWorley said Both men were from Saratoga Calif Authorities were unsure which man was the pilot Babb reportedly had been in San Antonio visiting his parents The plane crashed and burned in a field near a Super Kmart store and a movie theater near the San Antonio International Airport just after takeoff Saturday afternoon The plane a late 1970s model Mitsubishi MU2 turboprop air plane was bound for Tucson Ariz Investigators with the National Transportation Safety Board are expected to complete their onsite investigation of the crash Tuesday Ms Burkhardt Worley said In a couple of weeks the NTSB will meet with the manu facturer of the propeller Hartzell the manufacturer of the engine Honeywell and the planes she said In the meeting they will con duct a detailed examination of the propeller and The cause of the crash is unknown Jason Ragogna a Dallas NTSB investigator said Sunday the agency was considering pilot error mechanical failure and weather conditions as possible reasons for the accident A review of the tape between air traffic controllers and the air craft showed there was no dis tress call to the tower just before the plane went down A final report on the crash wont be issued for at least six months Texas Eagle going strong WASHINGTON AP Amtrak which nearly grounded its Texas Eagle just three years ago is pointing to the Chicagoto San Antonio route as one of the bright spots as it races to meet a congressional mandate to be financially selfsufficient within the next two years Amtrak says ridership on the Texas Eagle is up nearly 17 per cent for the first quarter of the fis cal year that began Oct 1 Thats a statistic welcomed by Sen Kay Bailey Hutchison who pressured the rail service to keep the Eagle alive Nationally ridership was up 1 percent for the quarter Galveston County Jail battles poisonous spiders HOUSTON AP A swat team combed nooks and crannies of the Galveston County Jail on Monday hoping to wipe out a gang of tough eightlegged perpe trators who have terrorized inmates in recent months Capt Mike Henson the assis tant jail administrator said 33 of the jails inmates have been bitten by brown recluse spiders since Oct 1 Eight inmates have been bitten this month alone Monthly pesticide treatments have had little affect at the Galveston Island jail so on Monday officials called in ento mologist Chris Gleeton of Indoor Pollution Control Services as a consultant Brown recluse bites are rarely fatal and frequently go undetected for days but they can be serious if left untreated said John Jackman a professor and extension entomologist for Texas University JAIl7From facility ShedSFBo er said he was very pleased le bit surprised the housing addition passed inspection the first time around I was concerned that there might be more Holder said But this jail has an excel lent reputation with the Texas jail system They like to inspect the jail because it doesnt have Until the county has need for all of the beds at the jail the dormitory beds will be rented for per day to federal governmental agencies such as the Immigration and Naturalization Service Renting jail beds a common practice statewide could allow the county to pay for the entire million jail expansion and renova tion project in about two and a half years Coun ty Judge Danny Scheel said The commission also inspected a new inmate 1 work release program building but the facility did not pass because of a minor bug jn the pro gramming for the smoke alarm controls Coun ty Engineer Tom Hornseth said The work release addition Building A includes 49 bunks and separate sections for men and women Holder said he thought the programming issue would be fixed soon and Building A would be ready for reinspection by the commission this week or early next week Construction on the jail expansion and reno vation project began in April 1998 and includes additional square feet of housing admin istrative and support areas Contractor Stoddard Construction originally had a September 1999 deadline for completion of the project but the county has since extended the deadline more than 100 days Hornseth said Because of repeated delays the county on Friday began charging Stoddard per day in liquidation damages to compensate for the lost revenue until the two housing sections were ready for occupancy Stoddard will be charged until the problems with the smoke detection system at the inmate work release addition are fixed and the building is ready to open Hornseth said Stoddard Vice President Secretary Stod dard said to the best of his knowledge the com pany had completed requirements of the contract The housing addition is only part of the pro ject contracted to Stoddard The project also includes remodeling of the administrative offices expansion of the communications department and a new evidence storage room and laborato ry All of the renovations have a March 1 dead line for completion board is really divided on the whole thing and we need to talk about what concerns we have when they meet at 6 at Bill Brown Elementary School 20410 Texas 46 West The controversy has raised credibility issues with many southwestern Comal County resi dents who say any attempt to move the school to the east side of 281 would betray the mil lion bond they approved in May 1999 On Dec 17 trustees rejected in a 43 vote buying a 20acre site along Borgfeld Road for the new elementary school Since then the board has looked at some property on the east side of 281 including locations near Stahl Lane and Smithson Valley Road On Jan 13 angry CISD patrons said they voted for the mil lion bond with the understanding the new school would be built near Timberwood Park a subdivi sion in Bexar County on the west side of 281 An attempt by trustees Robert Loop John Clay and Nick Nichols Road property mnught failia in a 33 vote Krueger was not present at the meeting Krueger said I called Wednesdays meeting because the board needs to get on the same page as much as possible and I wanted to get us all to see the big picture The board needs to be looking at the facts and not wrapped up in Voters passed a twophase bond plan this past year that included building three new elementary schools and one new high school in the Canyon Lake area During the bond campaign the district outlined three general areas for the new elementary schools and designated the area north of Canyon Lake for the new high school Krueger said he has not changed his mind on the Borgfeld Road property since the Dec 17 meeting Board members have different reasons for purchasing or not pur chasing the property There are varying reasons why the property was not selected that I cant dis he said Krueger said some concerns about the property were discussed in closed session Dec 17 Bertelsen said he hoped the board could reach an agreement Wednesday on how they planned to move forward If we remain split I hope at least we can decide how to approach this with the he said Bertelsen said he also hoped trustees could find solutions to what he saw as problems with Proposition 2 of the bond plan Krueger said Board members need to look at those things at the same time they need to look at whats best
