AUSTIN (AP) — A state district judge said Saturday he would not set further hearings for Rep. Tom DeLay until after an appeals court ruling, another blow to the former House majority leader’s hopes of regaining his post.
The move nullifies DeLay’s attempts to separate a remaining charge and proceed to trial on one count while the others are being appealed. Senior Judge Pat Priest also canceled a Dec. 27 hearing at which he was expected to consider aile • gations of misconduct by prosecutors who brought the charges.
DeLay, who denies wrongdoing, has been pressing for a quick resolution to his case so he can regain his majority leader job before his colleagues call for new leadership elections.
Earlier this month, Priest dismissed a conspiracy charge against DeLay but refused to throw out more serious allegations of money laundering. Travis County District Attorney Ronnie Earle is asking an

appeals court to reinstate the conspiracy charge.
Once the 3rd Court of Appeals has the case, Priest said he will not have jurisdiction until the court makes a decision.
“The hearings previously scheduled ... are canceled. I will set no other hearings until the appellate court has acted,’’ Priest said.
The appeals court is required by law to expedite such cases.
A spokesman for DeLay called the appealed charges “baseless.’’
“We’re confident that the appeals court will render a
decision based on the facts and the law that agrees with this sentiment,” spokesman Kevin Madden said.
On Friday, attorneys for DeLay had tried to prevent prosecutors from filing the case with the appeals court in an effort to keep jurisdiction with Priest and keep the proceedings moving. But the records were turned over Friday and will be on file in the court by Monday, Priest said.
DeLay was forced to step aside as majority leader in late November after he was indicted on state charges of conspiracy to violate Texas election laws.
