These new federal regulations are commonly called the Boiler and Industrial Furnace (BIF) regulations. This program is in addition to existing and recently enacted state permitting programs which regulate the same activity. As a result, Lafarge will be required to meet stringent EPA-based requirements when using waste-derived fuels at the Balcones Plant after Lafarge and Systech obtain required permits from the Texas Air Control Board and the texas Water Commission. Since BIF is a new regulatory program, facilities already engaged in the regulated activity or facilities having committed substantial resources for the purpose of engaging in the activity are entitled to file for what is termed interim status. Interim status allows qualified facilities to operate, or prepare to operate if they can meet the federal standards, even though EPA may not have issued a final federal permit The purpose is to allow facilities a smooth transition to permanent status under EPA regulations Even with interim status, Lafarge still must set ire state permits and comply with the federal BIF standards for such far iliti es before it begins to burn waste derived fuels. Lafarge's and Systech's permit applications have been pending for several years These applications are on hold awaiting the outcome of the environmental assessment commissioned by Lafarge.
