AUSTIN (AP) — The Texas Supreme Court announced Friday that it will hear arguments in a court challenge of the state’s school funding system in July, after the Legislature adjourns.
Lawmakers are considering changes in the way Texas funds its public schools during the legislative session that ends May 30. A state district judge ruled the $30 billion system unconstitutional last year.
But the high court’s opinion on the lawsuit won’t be known until well after justices hear oral arguments July 6.
Florence Shapiro, a Plano Republican and the Senate education committee chair, said lawmakers can’t afford to wait to change the education system. They need to move forward as planned, she said.
“I believe it’s a crisis,” she
said. “It's an issue the Legislature will have to decide on."
The House has already approved its version of a school finance bill. 'Hie Senate has introduced a separate plan but has yet to take a vote, and the chambers have shown lithe sign of reaching an agreement.
The court not hearing arguments in the case until summer could keep some legislators from wanting to vote on the issue this session, Shapiro said.
“It’s a good excuse for some not to do anything until after the Supreme Court hears the case,” she said.
Lt. Gov. David Dewhurst, a Republican, said the legislature should be the body to decide education funding.
"It’s out of the question for the Senate to punt this important issue to the courts,” Dewhurst said.

"I want to go to the trampoline,” Evan yelled, oblivious to the speakers on stage.
While his mother tried to keep a hold of his hand, Evan, cancer free for only six months, ran circles around her.
In the stadium stands, Esmeralda Ortega stood with her daughters, Samantha and Alejandra, and watched her mother, Irma Collazo, make her way slowly around the track.
“I didn't realize how emotional it would be,” Ortega said as tears flowed down her cheeks. “Seeing all these people in purple gives me hope they will find a cure in the future.”
When Collazo’s walk brought her closer to her family, the women stood up and cheered, pumping their fists in the air. They did not join her on the track because she wanted to do it herself.
“She didn t even really want us to be here, but we wouldn’t have missed it,” Ortega said. “ We ll probably go down and walk with her in a bit.”
At the edge of the track, onlookers cheered as the survivors entered the home stretch.

To honor both celebrities and family members who had lost their lives to cancer, the group created 67 stars, just like the ones in front of Grau-man’s Chinese Theater, and spread them out in front of their tent.
Taylor’s daughter, Michele Shelton, said her hand was still cramped from penning the names in block lettering.
The effort was worth it, she said, and not just in hopes of winning the evening’s “best dressed” prize.
“Six of my family members’ names are on those stars,” she said.
