Smith, one of the defendant! under indictment for killing Eli Ladd, was called at a witness for defense. In bis testimony he turned''Upon the gang and surprised eeery one by testifying that on the night before the killing he was in Bo* •ire store, and that Resell told him thatj “the nigger was in town/' and ‘let's ;I go and do him up,” and that they immediately secured their gone and started oat to hunt him down. This evidence completely took the backbone oat of the defense, nod Bosell’s attorneys asked thecourt to adjourn until this afternoon, that they might hare time to consider this newcondition of things. • .....
