Court Tuesday upheld the legality of an Iowa Jaw permitting use of revenue bonds by cities and towns to help finance new industry The high court ruled on a friendly suit brought by Jaime M Green former president o the Mount Pleasant Chamber o Commerce The City of Mount Pleatant was the first in the state to ap prove a revenue bond issue un der terms of the law passed by the 1963 legislature The purpose of the test suit was to gain a court ruling on the constitutionality jt the law The favorable ruling thus clears the way for a bonding company to guarantee the bonds Mount Pleasant voters ap proved a revenue bond issue last December to finance construction of a new plant there for Vega Industries of Syr acuse NY Tuesdays Supreme Court rul ing is expected to pave the way for other cities and towns to fol low Mount Pleasants lead The Supreme Court in its 80 opinion by Justice C Edwin Moore disagreed with the con tentions raised by Green Justice Moore said the law docs not violate the constitution al prohibitions against giving or loaning the credit of the state and there is no merit to a claim that the a c t embraces more than one subject matter and is therefore unconstitu tional Justice said neither is there any constitutional viola tion through permitting those engaged in manufacturing and processing to borrow money for plant facilities at rates lower than others He said the trial court cor rectly ruled against Greens contention that the plan for the city to take over the project started by the Henry County De velopment Corp is an unconsti tutional
