a employe of the Senate Sma GERTRUDE NOVAK Ossian boys hit as gun r NEW HAMPTON UPI Al Joe and Robert Kapell 9year old twin brothers were in satis factory condition at a hospita here Thursday being wounded by an accidental1 shot gun blast The boys sons of Mrs Mar jorie Kapell rural Ossian were wounded attheir farm home Wednesday Anight Authorities said the boys wen outside to examine a 12gauge shotgun a neighbor had re turned to Mrs Kapell While they were looking at the weapon the gun discharged Aljoe was wounded in the side and Robert was hit in the wristjand leg One of Roberts hands had to be amputated Chapm farmer hospitalized after mishap CHAPIN Dwain Schinagcl 46 was rushed to a Rochester Minn hospital Thursday morn ingin serious condition follow ing a tractor accident Schinagel was plowing new land on the farm belonging to his father George Schinagel a mile north of Chapin He ap parently fell off the tractor as he attempted to back up The tractor stopped after run ning overhis left arm and head His father when he saw the empty seat on the tractor went to the field and found him Schinagel was taken to Frank lin General Hospital before be ing transferred to Rochester Heavy No vote on Shaff Plan IOWA CITY RUniversity of Iowa students have voted heav ily against the Shaff Plan of legislative reapportionment in a mock election The students Wednesday voted 1122 about the motel venture and other transactions in which Baker had a part Baker 35 resigned as secre tary to the Senates Democrat ic majority after allegations of conflict of interest Mrs Novaks husband Alfred S Novak was Bakers partner in the posh Carousel Motel at Ocean City Md that was sold earlier this year to the Serv U Vending Co a vending ma chine firing with which Baker had dealings Novak died 1962 his death ruled a suicide and his widow inherited tusparfnership Mrs Novak told a reporter her husbands death came aft er years of turmoil that started with his interest in that motel Its just been one thing after another The motel opened with a party which drew Washington figures including Vice President Lyn don B Johnson but apparently fizzled financially under the BakerNovak management Committee investigators were reported to have questioned Wednesday the man who blew the whistle on Baker Ralph L Hill Hill is chairman of the Capi tal Vending Machine Co and plaintiff in a civil suit charging Baker and associates used im proper influence to cancel a vending machine contract in fa vor of another firm His suit is what brought to public notice Bakers wheeling and dealing and ultimately brought about Bakers resigna tion from his a year state job Hill was questioned in secret four hours not only about the a ouse o vending machine case but about Representatives has 108 Senate is based on population A provision preventing any county from more jthan one senator prevents apportionment on a strict populationjbasis Shdff Plan This plan is named for State 0 Sniff of Clinton WhoIntroduced it in its present form It has been passed by two successive sessions of the legis lature and must win approval of the voters Dec 3 to become law V The plan would establish a house with 99 members one to each county It would create Senate with 58 members based on popula tion County lines would be crossed to form the 58 districts but boundaries would have to conform to township or voting precinct boundaries A large countysuch as Polk would be subdivided into districts Population in each district could vary no more than 10 per centfrom of the states total population at the last fed eral census The population unit according to the 1960 cen sus would be 47544 A district then could be no smaller than 42790 depopulation and no larger than 52298 No one will know the exact makeup of the districts at the time of the Dec 3 election A commission of 10 members five from each major political party tfoiild have to submit a redis ricting plan to the Legislature by Feb 1 1965 The legislature could accept the plan amend it or enact a substitute If neither the com mission nor the legislature could agree on a plan by these dead ines the Iowa Supreme Court would be charged with establish ing the districts by Oct 1 1965 In any event the plan couldnt go into effect before the 1966 elections prior to the 1967 ses sion of the legislature Court position Last May a threemember ederal Court panel ruled that the present makeup of the Iowa Legislature is unfair v It caUedit invidious unjust discrimination the court pointed out that the House can be controlled by the 55 smallest counties represent ing 274 per cent of the state the Senate by tl 26 least populous districts repre senting 356 per cent of all lowans court decided by a 21 vote against ruling on the Shaf Plan at that time Judge Edward J McManus argued that the Shaff Plan i unconstitutional but the other two judges Martin Van Oosterhout and Roy Stephenson that submission o the Shaff Plan to the may serve some useful purpose and may have a direct bearing upon the rationality of the ap portionment proposed by it Further clarification is ex pected from reapportionment suits now before the US Supreme Court Alternatives If the voters approve the Shaff Plan the Federal Court panel has these alternatives Decide the plan constitutes acceptable apportionment Rule that the Shaff Plan ii unfair and direct the lowaLegis lature to adopt another plan giving guide lines Write its own plan and issue an enforcement order Return to the 1857 Constitu tion and elect 100 House mem bers and 50 Senators on a popu lation basis If Voters turn down the Shaff Plan the Federal Court panel could Suggest Iowa Legisla ture try again on court direc tive Write its own plan Return to the 1857 Constitu tional provisions As far as timing is concerned an alternate reapportionment nan could be put into effect for the 1966 elections if a special session of the legislature were called for 1964 to write a new amendment It would have to be assed again by the 1965 legis ature voted on by the people the same year and then be ready for 1966 elections Congo orders all Russians out FROM QUR WIRE SERVICES Supreme Court ordered her re tried on a legal technicality Awaiting trial also charged with murder is Bill Shindler accused of conspiring with Mrs Deyo Her husband Kenneth Virgil Deyo died more than Powers was downed over Russia and im prisoned 21 months Pilots wife LELAND Miss UPI The wife of the pilot of a U2recon naissanceplane that apparently crashed in the Gulf of Mexico said Thursday she was not giv ing up hope that her husband would be found unharmed Im a stubborn optimist7 said Mrs Marianne Hyde 1 believe my husband is going to be all right I refuse to believe anything different yet Mrs Hyde said two friends flew in Wednesday to tell her that her husbands plane was missing An oil slick and bits of debris were located in the gulf wherethe aircraft went down Mrs said she met her husband Capt Joe E Hyde Jr of La Grange Ga while he was stationed at nearby Greenville n 1957 They were married in July of the same year They have no children She said they were making their presenthome in Tucson Ariz but she came to Leland to stay with her parents Mr and Mrs Leo Gerdes about a month ago while her husband was away on duty She saidshe didnt know the type of mission he was flying I never cared to know and we figured I was better off the less I knew she said Mrs Hyde said her husband had never been involved in a crash since they were married but added Ive seen it happen to a lot of others Speaking calmly after a long night of apprehension Mrs Hyde said her present plans were indefinite Were just hoping for some news now one way or the other she said I guess theres no
