State Supreme Court for Dismissal DBS MOINES Iowa su preme court Tuesday reversed the Linn county district court convic tion of Harold M Cooper on a charge of violating the state liquor control act while state liquor com mission chairman The court in ruling Cooper did not violate the act remanded the case to the district court for pro ceedings in accordance with its B W Garrett supreme court clerk said that when the supreme court holds there has been no vio lation of the law the usual proce dure is for the district court to dis miss the action Up to Lower Court Justice J M Parsons explained that while the supreme court did not issue definite instructions to dismiss it is up to the lower court to take acion in compliance with the supreme court The higher courts decision was by a fense in that Farmer had no connec tion with the liquor the supreme courts majority opin ion said The court held that whereaa Cooper was indicted for permitting Farmer to possess illegal liquor the law under which the indictment was returned provides a penalty only for permitting members offi cials or employes of the commis sion to violate the act The opinion reprinted section 85 of the liquor control actwhich provided a penalty for a member or employe of the commission who shall knowingly or wilfully violate the act or aid assist or permit any such Shakespeare Is Quoted Much of the opinion centered about a definition of the word such and at one point the opinion cited a Shakespearean quotation let no such man be The justices concurring in the opinion used Websters dictionary to define the word agreeing with Coopers attorneys that the words such violation must refer to what precedes in the act and there is no other violation mentioned to which they can Coopers attorneys also argued if the statute had intended to maka it a crime for a member of the com mission to permit a violation by any and everyone in the state of Iowa outside the commission then it could and should plainly so used in section 85 means a violation by any they contended One Purpose The court held that the legislature in enacting the section under which Cooper was convicted had but one purpose to make provision to in sure proper performance of essential administrative by commis sion members and employes in their official capacities The opinion said that in another section the legislature made provi sion for enforcement by charging1 county attorneys sheriffs police and marshals of the entire state with the responsibility Specifically the supreme court construed section S5 KS forbidding those in authority to knowingly per mit violations by inferior officers ;
