unusual to march recruits into the marshes and waiers of this train ing base for disciplinary pur poses The testimony came from S Sgt Edward A Huff Chicago in the general courtmartial trial of Matthew C McKeon McKeon 31 Worcester is on trial for marching a 74j man recruit platoon into a tide swept creek to teach them dis Six drowned In the course of his testimony Huff who was McKeotis superi or in the training of the illfated Platoon 71 also was asked Did you yourself ever tell your pla toon in connection with their lack of discipline that If you dont snap out of it Ill take you down to the Huff who has been relieved of his duties as a drill instructor re plied I New Huffs evidence came immedi ately after thelawofficer Capt Irving N Klein New York City ruled that the training methods of Marines will be admitted as evi dence in the general courlmar tial Whether those methods had any bearing on McKcons conduct in leading the platoon into Ribbon Creek had become a sharp issue in the trial It was a major victory for Mc Keons attorney Emile Zola Ber man Ne York City In his ruling Klein said the evi dence would be admitted to indi cate whether McKeon was acting in a reasonable or unreasonable manner when he led the march In the course of the legal de bate one of the assistant gov ernment prosecutors said The issue is not whether he led them the recruits on a night march or into water but that he took nonswimmers into deep 10 The government has said the water was 10 feet deep while the defense maintains the depth is arguable ns a point of fact that the water was less than 10 feet where McKeon led and not above his armpits Even whether the men were nonswimmers is at issue in the case j Berman had pointed out in ask ing Klein to overrule the govern ments objection you are to de termine whether it was the exer cise of reasonable care by a rea sonably prudent drill instructor under the Therefore he argued the per formance customs and actions of other drill instructors in teaching the recruits discipline was a mat ter of pertinence Followed on Stand Pvt Earl Grabowski Kearney N followed Huff to the stand He was the first member of the illfated platoon to testify In telling of that grim march Grabowski said in a low voice When we came to C range had a stick and he was poking we made a column left McKeon j had a stick he was poking around on the ground
