was declared unconstitu tional Friday by District Judge G K Thompson Thompson asserted that if the act was upheld a similar law which will prevent the small grocer from advertising and selling week end specials will likewise be valid The law passed by the last legis lature makes illegal the sale of cigarets at less than defined cost The selling price for the whole saler was defined as cost plus per cent and for the retailer at cost plus 8 per cent Security Attempt He said the act was an attempt to obtain security from too much rugged competition Judge Thompsons 22page deci sion came in a test case brought by the Mays Drug Co of Cedar Rapids which contended the act was a pricefixing measure only and unconstitutional The state argued that it was merely aimed at preventing unfair business prac tices The judge said a fatal defect of the act was its failure to limit its application to cases where there was intent to injure competitors or destroy competition Not Carried Over The decision noted that the acts preamble referred to unfair busi ness practices which are demoral izing the wholesale and retail trade in cigarets and that the sale of cigarets below cost with intent to injure competitors is such an unfair practice This is not carried over into the act itself the judge said It is as though an act were passed in which the preamble re cited that the wagging of tails by dogs with the intent to knock the housewifes fine China or brica brac from its repository upon the whatnot is considered a malicious and dangerous practice and then the act itself proceeded to prohibi all canine tail wagging no matter for what purpose it might be in dulged in the judge observed State Rests Its Case in Mercy Killing Bridgeport Conn ff The state of Connecticut rested its 2nc degree
