damage sultbrot by Mrsolive Kilnkel against P A Saddler and his bonding company the National Surety for the death of plaintiffs son Donovan Klin Ice The crowds which packed he court room since the trial began were amused at Home of the sallies between the attorneys during the cross exami nation of some of the plaintiffs wit nesses Again many were serious when Mrs KlIntel wept as the clothes and photograph of her son were intro duced into evidence Mother on Stand Mrs Clinkel was on tho stand for an hour and a half in the afternoon She pictured hislast Illness and iden tified his clothes and show the value of his earnings In the various positions held by Klinkel j but none testified he held any one po sition for a lone tune After spirited objections contracts with some of the companies tending to show Kllnkcls earning capacity were ruled out Dr Julius NIemack testified yester day atternoon that the decedent died as a result of a bullet wound in the abdpmen Dr Niemack was not cross i examined I Hubert Momberg who is said to have been with Kllnkel in the cartlie day he was shot cfofroborated tlie testi mony of the other eyo witnesses that KUnkel was20 feet away when the bullet hit him not know Sheriff Sttdciler until after the shooting whenhewas in toll for an offense of his own The witness testimony was that the sheriff searched Kllnkel for liquor but did not find any also that Klinkel got out of his car in a calm manner arid walked to the sheriff and said Lets talk this over Testimony ot llombergs at the cor onersinquest was read showing that Members testified then that Kllhkel got out of his car kind of fast and that the distance between the sheriff nnd Klinkel was much less than 20 feet Mrs Leonard Kuhnle who was ah eye witness with her husband to the shooting preceded Momberg on the stand She save practically the same testimony as her husband to dis tance between Kllnkel and the sheriff and on cross examination by Harry Fitzgerald became confused in some
