Legislature inadvertent ly invalidated the vital gross in come fax provision on which a recent lax violation crackdown was based The high court issued the ruling in the case of Calvin Garland Des Moines bootblack who had been accused under the gross in come section of failing to file a slate income tax return in 1955 The court said Garlands failure to file the return was not a crim inal offense because he Legisla ture mistakenly repealed the gross income tax section in trying to amend the tax law THE HIGH courts ruling up held a decision by Polk County District Judge Carroll Swilzer who last year threw out of court the states case against Garland The state appealed the verdict because it was under the gross income proVision of the law on which most lax Indictments in the recent crackdown were based The high court in denying the appeal said the Legislature must inform the citizens with reasonable precision what acts it Intends to It quoted the rules and regulations issued by the Tax Commission for 1955 which says returns must be filed on taxable income and does not mention gross income The court further said the pres ent tax law does not meet one No Burdensome Boost in
