CLARION Feb first case taken up In Wright county district court this week was that of the Iowa Public Service company vs Municipal Utilities company of Des Moines rind Mayor Tompklns and members of the city council The Iowa Public Service company asked for a temporary In junction restraining the city council from carrying out its agreement with the new company which proposes to build a new light plant in Clarion Attorneys Price and Burnqulst ot Fort Dodge appear for tho service company while the Municipal Utili ties company and the city of Clarion was represented by Clark and Byers of Des Moines and Blrdsall and Archerd and Nagle and Hill of Clar ion Attorneys for the new company and the city acknowledged the exist ence of a contract with the Iowa Pub lie service company and that there was no evidence to show that the city Intended to break the old contract The city acknowledged that the old fran chise and contract were valid and pro posed to liveyUP to same until It shal expire about seven years hence A second suit between the same parties was an allegation that the city ordinance giving a franchise to the Municipal Utilities company was in vaJid for the reason that It was dual also that tho city has no power to ac cept the proposed new light plant as a gift In this case the defendants at torneys cited the fact that the ordn ance under which tho Iowa Public service company was supplying elec tricity to the city was also dual In that case if the old ordinance is il legal the Iowa Public Service com pany Is outsldo the law and has no right to conduct a lighting plant In Clarion The law gives the city the right to erect and maintain a power plant and it would seem only logical that It coajd accept it as a gift after the voters had already ratified the same by a vote of more than three to one These two cases have occupied tlnea days of the courts time this week The situation Is most unique and Judge Fry has stated that he will render his decision in the
