free press is one of the greatest means of guaranteeing a free people Miller addressed both houses of the legislature He blamed the Judge William P Butler erred in allowing a Highway patrol man to testify that in his opin ion the car was traveling be tween 55 and 70 miles per hour when it left the gravel road It said the testimony amounted to no more than spec ulation since there were no skid marks of any kind and the patrolmans opinion was based oa the amount of damage to a fence a broken guy wire and the condition of the car It said Mr and Mrs Bublitz were en titled to a new trial because of this error The high court re jected a contention of Mr and Mrs Bublitz that there was in j sufficient evidence they were negligent in allowing their son to drive on the road when he had no license The opinion said there is not sufficient evidence to support a claim of reckless operation of tfie car by Dean Bublitz but that the jury could properly find him guilty of failing to maintain a proper lookout and negligent operation of the car It said the motion of Darrell Bublitz for judgment not with standing the verdict should have been sustained because there was not enough evidence to show that he allowed a reck less person to drive his car The courts opinion indicates Dean did tell his mother he was going to take his brothers car to drive to a 4H Club meet ing The boys had attended the 4H meeting and then went for a ride Scalf said he formerly was an old Des Moines girl Sept 22 1961 In the unanimous opinion Jus tice Bruce Snell said There was evidence in this case of debauchery licentiousness and the defilement of an 11year old child in the name of religion The disclosures were shocking to the sensibilities of decent peo P5e The Supreme Court said Scalf s 35year sentence was not exces sive punishment as alleged byi Scalf in his appeal Scalf has been free under 000 bond pending the appeal Implied consent bill endorsed for passage DES MOINES im plied consent bill providing drunkometer tests for motorists Monday became the first liquor measure to receive the endorse ment of the House Safety and Law enforcement committee The bill firmly backed by dry forces and safety offi cials would require motorists arrested on suspicion of drunken driving to submit to chemicalj tests for intoxication j The proposed law would fixi an implied consent to submit to the tests by obtaining a drivers license The House passed such a bill on v u but the measure died in a Sen ate committee A companion bill to the House proposal has been introduced in the Senate Kennedy administration for what he called a policy of news man agement in Washington and said this is one reason for much of the current unrest over Cuba Miller a former member of both houses of the Iowa
