Senate in Struggle By WILLIAM EBERLINE DBS MOINES behindthe struggle between the Senate and the governor has created a legislative log jam as far as ap pointments to state jobs are con cerned Under state law Gov Leo A Hoegh is required to appoint per sons to the various state agencies The Senate must confirm the nom inations by a twothirds vote if they are to become effective So far Gov Hoegh has sent seven nominations to the Senate But only of Mrs Martin Van Oosterhout of Orange City to the State Board of Public Instruction has been affirmed The basic question underlying the controversy is Should the gov ernor be allowed to appoint anyone he wants to the state agencies as long as their qualifications and moral character are satisfactory Big Part Most senators say he should in theory at least But they hasten to add that political considerations play a big part in the controversy Further complicating the log Jam is the oftrecurring dissension in the State Commerce Commis sion and a political disagreement which has led to withdrawal of two names submitted by the commis iion as its legal counsel Hoeghs nominations for the State Highway Commission are the center of the storm The governor nominated Robert K Beck gen AP Wircphoto eral manager of the Centerville Daily lowegian Russell F Lundy Des Moines Chris Larsen Sioux City and L L Caffrey Cresco as commissioners All but Caffrey are Republicans Caffreys nomination was reject ed by the Senate reportedly be cause he had attacked the hon esty and integrity of an elective state official But several senators said the real reason was that Sen ate leaders wanted the governor to reappoint one or more of the pres ent commissioners His nomina tions would leave only Melvin Graham of Democrat a holdover member Gov Hoegh has said he does not plan to name anybody else for the commission I have sent up the names of four good people and as far as Im concerned thats he de clared Denied Rumors Lundy also came in for criticism when he wrote Sen J G Lucas RMadrid a letter denying ru mors that he is interested in the asphalt business The letters contents were pub lished and Lucas was identified as chairman of the Senate subcom mittee checking into Lundys qual ifications Members of these sub committees are supposed to be kept secret to protect them from public criticism if they reject a DRAMATIC RESCUE FROM flames three weeks ago Both Hoegh and Senate Majority Leader Duane Dewel RAlgona said they believed Housel could continue to serve since the gover nor had submitted his name for reappointment But Asst Atty Gen Oscar Strauss ruled that Housels term expired 30 days aft er the opening of the Legislature that he cannot resume his post until he is confirmed Mercury Down to 18 at Spencer Warm Trend Seen DES
