payment case was Brought against the city mayor and other officials by A M Schanke a defeated City Coun cil candidate He contended that the salary increase from lo yearly was illegal since the ordi nance granting it was published after the city election in which the mayor was reelected It was passed the night before the elec tion THE DISTRICT COURT ruled that since it was passed before the mayors taking of office Jan 1 it was legal The Supreme Court in upholding that decision said that it was not its duty to pass judgment on the propriety of the councils action It merely ruled on the
