praised Pappas and his as sistant Howard Dresser for ob taining the conviction of Fisk Testimony showed that Fisk of fered to plead guilty to the lar ceny charge if Pappas would drop the habitual criminal charge Fisk has a fourpage police record dating back to 1931 He ad mitted in his testimony that he was guilty of felonies other than the two breaking and entering charges No Sentencing No time was set for sentencing by District Judge Tom Boynton because Fisks attorney Gilbert K Bovard was unexpectedly called out of town Fisk and his mother Mrs E A Fisk 64 showed no emotion as the verdict was read by Clerk of Court S H MacPeak Fisk said he wanted to get the sentenc ing out of the way as soon as possible In testimony Tuesday afternoon Fisk claimed he was in Arizona Tennessee and al at 1524 N Federal Dr Cady was born April 26 897 at Blue River son of George Willis and Mary Cady He moved to Algona and later came o Mason City He attended the Mason City schools and was grad uated found in a parked car outside the Williamson Ford Building here early Wednesday Police identified him as Frank Bruggenwirth about 24 Clinton He was shot in the lower spinal region by Policeman RUSS Ellis who chased him down an Ellis and officer Wally Swanson said they found a window open in the auto dealers building and when they went to investigate they noticed a car parked nearby with a Clinton County license The car drove off the officer said and they followed and curbed it A man jumped out and ran down an alley The two officers pursued the man on foot Swanson fired sev eral shots in the air before he stumbled and fed Ellis who was running behind continued the chase and fired one shot low intending to hit the man in the leg The man went down with a bullet wound in the lower spinal region officers said He died later at a Davenport hos pital Police later checked the Wil liamson Ford Building and found no entrance had been made They said the man apparently had beenjhim in the November general publicans with 10 additional votes and Democrats with 14 more votes But the preference results are not binding on the delegates Eisenhower was expected to have virtually all the 50 GOP delegates chosen to go to the Re publican nominating convention and delegates with 10 votes to be picked later in a state convention The Democrats also chose dele gates with 50 convention votes Twentythree of the delegate can didates were for Stevenson and three had declared for Kefauver with the other open minded or uncommitted The votes still were being counted in the Democratic delegate races Delegates with 14 votes will be selected later at a state convention Far Short No delegates are bound by the preference outcome The Kefauver writein vote fell far short of expectations His sup
