Gas permit stalled by legal battle CALGARY (CP) Legal arguments on whether the Alberta Energy Board should make a ruling on fundamental constitutional issues were the main point ,of debate at a board hearing here. The board is re-examining an export permit for natural gas granted to Consolidated Natural Gas in 1969. The gas originally was intended for United States markets, but an export permit was denied by the National Eqergy Board and it now is going to the On- tario market. The Ontario government and Ontario Hydro have ques tioned on constitutiona grounds both the Albert; legislation under which th( Alberta board operates anc the order-in-councL instructing the board to re- examine the Consolidated per- mit. Arguments were heard on whether the Alberta board should deal with the con- stitutional issue. But chairman Dr. George Govier said more time was needed to examine the matter. Ontario intervenors argued the board should rule on the constitutional issue while Con- solidated and several other parties said this was a matter for the courts to decide. MPs rap report on prices OTTAWA (CP) Two op- position MPs criticized Wednesday Chairman Beryl Plumptre of the food prices review board for her report on food prices. James McGrath, Progressive Conservative spokesman on food prices, said Mrs. Plumptre, who is paid a year, would think differently about rising prices "if she had to make do on a working man's income." He said in a telephone inter- view from his riding in St. -John's, Nfld., that Mrs. Plumptre should resign and retire to her home in Rockcliffe, a fashionable residential district of Ottawa. Terry Grier, the NDP spokesman on food prices, said Mrs. Plumptre seems to be living in a different country. "Many of the Canadians I've talked to say rising food prices constitute a crisis in their he said in a telephone interview from Toronto Lakeshore. J. H. Laycraft, representing Consolidated, said the board was not an appropriate tribunal to deal with the ques- tion of whether the legislation under which it operates is ul- tra vires invalid. The board was being asked virtually to end its own ex- istence. Any decision it made would not be binding on par- ties and final constitutional decisions could come only from the courts, he said. This argument was sup- ported by counsel for Alberta Gas Trunk line, Canadian Western Natural Gas and Pan Alberta Gas Ltd. Robin Scott, counsel for the Ontario attorney general's department, said the sugges- tion that the board was being asked to end its existence was almost a "scare tactic." It was necessary for the board to make a preliminary determination for the purpose of the hearing, he said. But it could not make a binding or conclusive decision. Robert Macauley, representing Ontario Hydro, said it was unacceptable to suggest that a board ruling which declared the provincial legislation invalid would put it out of business but it might mean a lot less work for some distinguished Alberta civil servants.
