MUSICIAN HOPEFUL NEW YORK (AP) Musi- cian-conductor Lyle (Skitch) Henderson moved for dis- missal of his income tax eva- sion indictment here on the ground that former president Richard Nixon was not prosecuted for a similar deduction scheme. Henderson's lawyer, Louis Bender, moved in United States District Court to have the charges resulting from the donation of musical scores to the University of Wisconsin set aside as "discriminatory and selective prosecution." Nixon claimed a tax deduction for the donation of his presidential papers to the National Archives, but it was later disallowed by the Inter- nal Revenue Service. Henderson, 56, claimed a deduction for donating scores he had written for the NBC Tonight show. The indictment charged the collection was "virtually worthless."
