Lethbridge Herald, The (Newspaper) - October 3, 1973, Lethbridge, Alberta First batch on sale Tuesday Wednesday, October 3, 1973-THE UETHBRIDGE HERALD-11 Uncle Ben ready to flood Alberta markets f HKO DKKR (CP) After one year of fighting an inter- national union and the Alberta Hoard of Industrial Relations, lien Ginter says he is ready to send beer from his new brewery to market. The British Columbia in- dustrialist said in an interview he expects the first batch of 100.000 dozen beer bottles to be on sale at outlets of the Alberta Liquor Control Board by Tuesday. Peter Elliott, chairman of the liquor board, confirmed outlets will be selling beer from the new Red Deer plant "sometime next week." However, a spokesman for union officials indicated the start of output from the Red Deer plant is not likely to proceed without a continua- tion of the controversy that has surrounded the brewery since last summer when construction was almost com- plete. Harry Chivers. counsel for Local 250 of the International Union of United Brewery. Flour. Cereal. Soft Drink and Distillery Workers, said he will file an appeal against the decision of the Supreme Court of Alberta that effectively allowed Mr. Ginter to start brewery operations in Red Deer. Mr. J u s t i c e M i c h e a I O'Byrno ruled the Board of In- dustrial Relations erred in granting the Kdrnonton-based local jurisdiction over brewery workers at Red Deer. Mr. (iinter said he is going ahead despite any appeals from the union. The brewery remains non-unionized. "We've lost loo much from this at fantastic cost for me to stand still. We've had a lot of dirty publicity." Mr. (iinter said he had no objection to the of workers at the Red Deer Brewery. His objection has been the location of the union base in Kdmonton. and in I he plant of a competitor, namely Labatt's. I n his r 111 i n g. M r. Justice O'Byrne ruled the Red Deer group of 30 brewery workers constituted a proper bargaining unit. Mr. (iinter. sole owner of the Red Deer brewery and president of the company. Un- cle Ben's Brewery (Alberta) Ltd.. that operates it. said he still did not object to a union attempting to organize the workers "no matter who they arc as long as they have good intentions." His four other es- tablishments in the beer and wine industry at Prince (i e ro g e. R i c h mo n d and Kelowna. in British Columbia. and at Winnipeg were all unionized. In a fight that began last summer as the brewery prepared to move from construction to production phases. Local 282 of the union sought certification for the prospective workers at the plant. The charter for Local 'IWl was later withdrawn, and Local 250 sought and gained successful certification from (he Board Relations. of Industrial In the wake of that battle, the Board of Industrial Relations ordered Mr. Ginter to take back men laid off as a result of his refusal to accept Local 250. and also pay back wages. Mr. Ginter reported the Alberta government had in- formed him that with the start of production, he now could expect the industrial development grant approved by the former Social Credit government.
