Lethbridge Herald, The (Newspaper) - May 16, 1973, Lethbridge, Alberta Wednesday, May 1973 THE LETHBRIDGE HEKAID ft France expected to defy court order against N-tests By ROD CURRIE Canadian Press Staff Writer Although Australia and New Zealand have put France in the dock at the World Court in The Hague, they have little hope that France will obey a court order against planned nuclear tests in the Pacific even if they win their case. There are precedents for countries defying world court orders and France in 1966 ex- pressly stated it would not rec- ognize the court's powir to deal with French defence issues. Indirectly, the government is supported by the French people through their singularly apa- thetic attitude toward the whole issue despite protest activities in London and other European capitals. Although Australia and New Zealand are pessimistic about the outcome, if nothing else the court proceedings which start this week will serve to spotlight world opinion on the tests. They wast the French atmospheric tests stopped and in the mean- time they want the series scheduled for mid-summer at least suspended while the court hears the case. Australia attracted new atten- tion to its case when trade un- ions decided to boycott French products and the new labor gov- ernment of Prime Minister Gough Whitlam said it does not rule out the possibility of sev- ering diplomatic relations with Franco as a last resort. New Zealand unions are con- sidering similar action against French imports but the govern- ment is unlikely to resort to breaking diplomatic ties. Observers note that their court action is simitar to that taken by Britain and West Ger- many for an injunction ordering Iceland not to expand its fish- ery limits to 50 miles while the court was hearing the dispute. Iceland ignored the injunctions and the expectation' among most observers is that France would do the same. Although the Australians, in particular, are genuinely angry over the French attitude, and a protest group set out from Lon- don during the week on a March to Paris, the French public and press have been in- different. There have been a few isolated anti-nuclear dem- onstrations but what French op- position there is centres mainly on the drain of the nuclear pro- gram on France's economy. Nuclear disarmament as a cause has never caught on in France as it did hi Britain prior to the 1963 test ban against at- mospheric tests, or in Canada and the United States prior to the underground U.S. test two years ago in the Aleutian island of Amchitka. French toade with Australia is small and although the dis- pute raises the possibility of France withdrawing from a multi-million-dollar uranium en- richment project, the present Australian government seems confident on this point. This threat may have detarred the previous Australian Liberal government from being too out- spoken against the Freach, but many observers feel the French atomic commission is far more eager for the Australian ura- nium than the Australians are.
