Mr. Barr was commenting in an interview on a Supreme Court of Canada decision that an Ontario tavern failed to meet its obligation to a cus- tomer who was hit by a car after drinking to excess on the premises. The court said the hotel should have called the police or a taxi to take the patron home and awarded more than damages to the man. Innkeepers will try to get those intoxicated to take a taxi home, but "we can't infringe on their human Mr. Barr said. The person may not want to take the advice and "it seems the minute you say 'can't' to someone these days, they go straight to the human rights people." Peter Elliott, Alberta Liquor Control Board chairman, said beverage room operators are aware of their responsibility to patrons. "I have brought it up at meet- ings of the hotel association and warned them, it can come back on them if they continue to serve an intoxicated he said. Liquor legislation prohibits serving those who obviously are drunk, "but we know it hap- Elliott said. Both Mr. Elliott and Mr. Barr agreed it sometimes is difficult to tell whether a person is in- toxicated. "He may look okay until he tries to stand up."
