IN. nun nOQOT HWIOMV Data banks Federal justice department struggling with problem By STEPHEN SCOTT OTTAWA (CP) The justice department is struggling with the complicated problem of how to legislate protection of per- sonal information stored, in thousands of data banks in North America. officials say they- cannot say will be introduced in the Commons that might bear the label Protection of Privacy Part II. Word that the department is working on the problem was dropped in the Commons Thursday by Communications Minister Gerard Pelletier. He said the intent of proposed legislation is to allow individuals to determine what information about them is stored in computers and to let them correct errors. His remarks implied that the legislation might see the light of day fairly soon. But a spokesman for Justice Minister Otto Lang could not give any such assurance Friday. The spokesman said the de- partment is working on the matter but no legislation can be expected in the near future. He could not say even whether there will be any this year. BANNED WIRETAPS When a bill'is produced, it will be another step by the government to protect privacy. The first step, banning most wiretapping, was passed by Parliament late last year. That legislation took almost three years of Commons debate before it became law. There are indications that data bank legislation could take just as long. The problem is more com- plicated to legislate than wire- tapping, some sources say. Government consideration of the matter is a response to fears expressed by many, in- cluding consumer advocates, about abuse of technology that permits easy storage, quick retrieval and simple transmission of information about individuals. Information on everything from consumer credit, employment records, traffic violations and doctors reports can be centralized easily in one data bank or transferred from one bank to another. The dangers are many. All information, accurate pr in- accurate, could be transferred without the knowledge of indi- viduals concerned. Basically, the government will seek to legislate the right of all individuals to be able to see and to correct information about themselves in the banks. But justice department law- yers are digging deeper than that. Their problem is how to prevent information on individuals falling into wrong hands. For instance, traffic offence information legitimately may be made available to insurance companies. But should that same information be available to a potential employer or someone drawing up a credit rating? While it appears unlikely that data bank privacy legislation will reach the Ccmrnons this session, the tarone speech has promised legislation to assure Canadian control of the computer communications field. Mr. Pelletier said Friday that this legislation will seek Canadian control of data banks and the means of transmitting information between them. Court system defended VANCOUVER (CP) Justice .Minister Otto Lang Friday night strongly defended his method of appointing judges, saying it would be an irresponsible abdication of duties to appoint only men irith long seniority to the position of chief justice of a court. Mr. Laskin, 61, a junior member of the court, was. appointed in December, breaking a tradition of appointing the next senior judge to replace a retiring chief justice. Reports at the time said there was anger in and out of the court that Mr. Justice Ronald Martland, 66, of Alberta was not appointed to succeed retiring Chief Justice Gerald Fauteux. Mr. Lang said he sees no merit in artificially limiting the range of possible choices for the position of chief justice. "Why should we look only at the senior man on the court in question? Or only at members of that court? Or only at per- sons who are already judges? At the same time the minister responded to speculation of changes resulting from the ap- pointment of Chief Justice Laskin. He said there have been suggestions that the chief justice would radically alter the role of the court as well as the. conclusions it would reach in particular cases.
