D, L. McVarthy, K.C./ of Toronto, and an English counsel will appear tor the public school board and possibly, also.' H. G. liar^; ot iieglna; while Hon. Frank liiissel. K.C., will appear for John McCarthy, "vvho represents the interests of the Gratton school district. It is not known here which English counsel .will be associated with Mr. Russel in the appeal. T^o attonioy-general'fl department will/bo represented by an ICngUsh counsel, ac^oraing ^^o a statement made at the government offices today. The appeal is of wide-spread in terest because It effects the principle ot the autonomy act. The public school board contends that the scbdol law was not Intended nor does it mean, that citizens ot the Roman Catholic falfii should be deprived of their rlgjit to support public schools and have their children educated at public schools. It is also contended thaf even i�;itlie law could bo so construed, it was hot within the competence ot tl;o Dominion to enact that portion of the aiitbuomy'bill which results In' the coercion ot any citizen on the grounds or his religion. When the Saskatchewan legislalnre eamo into being it re-enacted the Bcliool clauses ot 1901, aid it is con-toiulqd that at any time,' and for nuniljor ot years later, many Roman Catholics supported public schools and that their right to do so 'wis never qiiestioned, until Hon. Walter Scq|,t in trodilced and passed an amendinent w'lilch'was based on the contention of Bomo Roman Catholics were obliged to support the separate and not the public .schools.
