(CP) Confusion clouded some evidence Wednesday as an inquest into 23 deaths at Sudbury General Hospital was told about a cross-connection in the medical gas system in the new wing of the building. Jack Leppinen, a representative of Canadian Liquid Air Ltd., said a test on the cross-connection conducted on the system in 1973 might not have been conclusive. He told the coroner's jury that, in retrospect, he realized that if a cross-connection ex- isted it might have gone unde- tected during the test because of the complexities in the gas flow. Canadian liquid air was the gas supplier at the hospital. The firm also supplied the equipment and, according to contract, was to oversee final tests. Mr. Leppinen told jury fore- man Barry Farmer that he now realized his test was not conclusive. Mr. Farmer asked him at the inquest: "If you were to trace the gas system (from rooms on the main floor of the new wing) right back to its sources, then could you say that the test you did in January, 1973, was con- "No, sir, not going right back to the Mr. Leppinen replied. QUESTIONED BY CROWN The conclusiveness of Mr. Leppinen's test was questioned also by Crown Attorney John Takach, who has been directing the 23 days of. evidence before Dr. Ross Bennett, Ontario's deputy chief coroner. Mr. Leppinen was to return to the witness stand this morning, after spending all day Wednesday and part of Tuesday answering questions by Mr. Takach. The gas company official said his test was conducted in late January after plumbers had completed hooking up a branch system feeding gas into four rooms of the new fdo Defend, a foreman for Comstock International Ltd., which installed the system, has testified that he might have connected an oxygen fine to to a nitrous oxide line and a nitrous oxide line to an oxygen line because of a labelling error in the plans of the gas system. Last Sept. 7, Catherine Do- minic died while receiving nit- rous oxide from an oxygen wall outlet. The inquest is into her death and the deaths of 22 other per- sons who received gas in four rooms of the hospital that the cross-connection is known to have affected. Languages decision reserved OTTAWA (CP) "Expressio unius est exclusio alterius." This legalistic Latin maxim, which sounds a bit like a family motto and translates as "all that is stated is all that is would be the epitaph of the Official Languages Act if lawyer Joseph T- Thorson had his way. Mr. Thorson, a highly vocal opponent of the act since its inception five years ago, was representing Mayor Leonard C. Jones of Moncton, N.B.. in his appeal to the Supreme Court of Canada against that province's decision to implement bilingual courtrooms. The nine high court justices has reserved decision and it may be as late as June before there is a ruling, inces find out whether their biiingualism programs are constitutionally legal. Mr. Thorson's argument, which began Monday, was based mainly on section 133 of the British North America Act. Section 133, part of the origi- nal act of 1867, says that Eng- lish and French "may be used" in the debates, records and publications of Canada's Parliament and the Quebec legislature as well as federal and Quebec courts. Section 91, as amended in 1949. says power to amend the constitution is subject to certain exemptions, including "the use of the Eng- lish or French Language." This is where Mr. Thorson used his Latin, arguing that section 133 of the SNA Act is a restrictive maximum, which Ottawa and the provinces violate by passing tnlingoalist legislation. ;
