Lethbridge Herald, The (Newspaper) - February 12, 1975, Lethbridge, Alberta 18 THE I.ETHBRIDGE HERALD Wednesday, February 12, 1975 Criminal record law to be tightened OTTAWA (CP) The gov- ernment might make it illegal to disclose another person's criminal record if that person has been pardoned under the Criminal Records Act, Solicitor-General Warren All- mand said in the Commons Tuesday. He said amendments will be introduced later this year to correct "many deficiencies" in the four-year-old Criminal Records Act. One deficiency was that even after a pardon "you can't stop a credit agency or a new- spaper or anyone else from saying that a person has a criminal record." "The amendments that we plan to bring forward will deal with that particular defi- ciency." Asked outside the House how he could .prevent a new- spaper from publishing the fact that a person had once been convicted of a criminal offence, Mr. Allmand replied: "We are thinking of making that a criminal offence in itself. "We couldn't make it a serious offence, but you have to try to stop people from revealing the record when a person has been given a par- don." He said in the Commons that since the act was passed in 1970, the government has granted pardons. "But the pardons that have been granted have not been as effective as we hoped they would be in protecting a former -inmate from dis- crimination." Under existing law, employ- ers under federal jurisdiction are forbidden to ask if a person has ever been con- victed of a criminal offence. Instead, they must ask if a person has been convicted of an offence for which he has not received a pardon. Mr. Allmand said Ottawa now is negotiating with provincial governments and hopes to introduce an amend- ment covering employers un- der provincial jurisdiction as well. Mr. Allmand said another deficiency in the existing act is the provision which re- quires parole boards to deter- mine whether an applicant has been on "good behavior" since his conviction. The names of persons apply- ing for pardons are turned over to police. "Many people have told me that they won't apply for a pardon because they don't want the police snooping around telling everyone about their pardon application." The solicitor-general said there is a danger that police or parole boards will regard a different lifestyle as poor behavior and reject the application. "He might have long hair and a beard, he might belong to a minority religious group, he might even have a common-law Mr. Allmand said. "And the man is refused the pardon even though he has not been engaged in any criminal activity." Amendments would eliminate "judgments which relate to a man's personal morals or his personal lifestyle." He was speaking during de- bate of a private members' bill which was talked out. Philip Rynard (PC-Simcoe who introduced the bill, said the government should eliminate "disgraceful provisions of the Criminal Records Act which bar the progress of young offenders who make a once-in-a-lifetime mistake."
