Lethbridge Herald, The (Newspaper) - February 11, 1975, Lethbridge, Alberta 14 THE LETHBRIDQE HERALD 11, 1875 Convicted pusher loses civil suit EDMONTON (CP) An Alberta Supreme Court judge has dismissed, a civil suit brought by a convicted drug trafficker against a doctor and four policemen. Russell Richard Reynen had alleged that Dr. David An- tonenko performed an anal ex- amination on him in June, 1973, without his consent. The physician testified that he per- formed the examination, but only after being told by police officers that they could authorize such a search. Dr. Antonenko said he removed 25 capsules of heroin from Reynen's rectum. Reynen is serving an eight- year prison sentence for possession of heroin for the purpose of trafficking. Mr. Justice Hugh John Mac- dpnald, in an 11-page judge- ment released Friday, said the police "had not only the right but the duty" to search Reynen and seize any drugs they found. The officers nam- ed in the suit were Constables Louis Hud on and James Graham of the RCMP and Detectives Noel Day and Norman Strausz of the Ed- monton city police. The judge found that the "actions of the police officers in obtaining the medical ex- amination was done in a reasonable and proper manner, and without any un- reasonable force or threat to the health and well being" of Reynen. Mr. Justice Macdonald said he accepted the evidence that Reynen suffered some dis- comfort but was not injured by the examination. He made it clear that he was not authorizing widespread use of rectal searches, but said such action must be reasonable and proper according to "all the circumstances of the par- ticular case." "It is impossible to lay down any hard and fast rule to be applied to all cases.'' Baby Arafat PHILADELPHIA (AP) A Philadelphia couple that wanted to name its baby after someone famous chose Palestinian guerrilla chief Yasser Arafat. The couple's two month old son has .been named Yasser Arafat Colbert. "We believe in him says Mrs. Robert Colbert, 42, after hearing that Lebanese newspapers publish- ed pictures of her baby on Sunday. "We think he's a terrific man." Lifesaving balloon developed KIRKLAND LAKE, Ont. (CP) Don Wertman of Kirkland Lake says he has developed a device which might help lost persons attract, the attention of searchers. The pocket-sized housing of the device contains a bottle of compressed gas and a fluor- escent balloon which will rise to about 300 feet when inflated with the gas. The balloon is tied by a cord to the housing on the ground, he said. Mr Wertman is negotiating for the sale or licensing of the device. "I got the idea because I kept reading' in the papers that people who had been lost often said that a search air- craft flew right over them but did not spot he said. Reward set for return of painting HARTFORD, Conn. (AP) Museum officials have offered a reward for the return of a Gainsborough painting stolen frorti the oldest United States public art museum. The 18th-century painting, Woody Landscape by English master Thomas Gain- sborough, was cut from its frame Thursday at the Wadsworth Atheneum.
