Ellison, Trustee for the Ellison Milling and Elevator Company, Limited, that in consideration of certain �� emptions from taxation to be given, and of(cortain rates to be fixed for the supply of water, the said Ellison Milling and Elevator Company Limited shall enter into aa agreement setting forth the terms upon which said exemptions and special ratea or rebates shall be given. AND WHEREAS this bylaw is to take effect on the Fourth day of September, A. !>., 1006. Therefore the Mayor and Council of the City of Lethbridge enact as follows: 1. That this bylaw shall take effect on tho Fourth day of September 1906. i! That the Mayor and Council of the City of Lethbridge will grant to the Ellison Milling and Elevator Company Limited, exemption by the Municipality from taxation (whether in respect of municipal, school, or other taxes, rates or assessments, other than local improvement taxes, aud local improvement aasessmenfe) for a term of fifteen years from the coming into effect of this bylaw, upon all real and personal property ""of the said Company, together with the milling, elevator, grain aad dour business and businesses usually or necessarily incidental thereto to ho carried on by the said Company and upon all earnings or income to ' be derived by the .suld Company f/om such mills and elevator, but subject to the covenants to be contained in an agreement between the City and the said Company as hereinafter set forth. 3. That upon the passing of this bylaw the Mayor and Council of the City of Lethbridge are hereby authorised and empowered to enter into an agreement under seal with said Ephraim P. Ellison, Trustee for the | Ellison Milling nnd Elevator Company Limited, In this bylaw called "Tho Company." containing the obligations.- stipulations and conditions on the part of tho said Company and of the City respectively hereinafter set forth:- (a) On the part of the Company, that it shall, at or before, the delivery of such agreement execute and deliver to the City a bond for the sum of one thousand dollars, with a satisfactory surety or sureties, which bond shall be conditioned for the performance by the Company of the cov cnants and agreements therein entered .into to erect and carry^to completion tho mill referred to .In paragraph (o) hereof. (b) Oh the part of the Company, that iinincdiately after the approval by the burgesses of the, CiCy^of lethbridge and the passing by the City of a bylaw ratifying and confirm ng the terms of such agreement it. shall; procure incorporation in the province of Alberta under "The Companies Ordinance" under the name of the Ellison Milling and Elevator. Company, Limited, if Such name .Is avallni0 barrels during every 31 hours, nnd upon It so erecting and carrying to completion the said mill, tho bond referred to in paragraph (u) hereof shall be delivered up to the Com  pany to be cancelled. (d) On tho part of the City th*vf it will grant to the Company total exemption from taxation by the City (whether in respect of muntc -I pal, school, or other taxes, rates or assessments, other than local Improvement taxes and local Improve  ment assessments) for a term of lif  teen years from the coming Into ol-feet of this bylaw upon all real and j personal property of the said Com- j pany, together with the milling, ele- i vator, grain or flour business or j businesses usually or necessarily :n-cidental thereto carried on by the said Company, and upon all earnings and Income to be derived by the said Company from such milling, elevator or other business or businesses, or any such property as atoivsaid. e) On the part of the City that it will during the whole period of exemption from taxation referred to in this bylaw, whether for the term of fifteen years above mentioned or any subsequent term for which exemption may pursuant to such agreement be granted, supply to the Company at all times such water as the Company may require for the ' purposes of Its business at a rate not higher than any rate at which water is bow or may from time to time hereafter be by the said City sup plied or given to any business or industrial enterprise within the City (excluding any railway Company with which the City may hate a-greed und which the City shall litres hereafter to supply water for railway purposes) and that the rate to be charged by the City for any water to be supplied to the Company during any period of exemption as heroin set out; shall not in any event exceed the sum of eight cents per thousand gallons. ((> On the part of the City that the Company shall at all times dur  ing any period In which it shall . be entitled to an exemption from taxation hereunder, have the right to take and use without charge any surplus water that may be conveyed to and he the property of the City of lethbridge through any irrigation ditch, ditches or canals provided that the Company shall not be entitled to use the said water until the City shall have taken from the said ditches or canals or any of them such water as may he required by the City for the purposes set out in By-law No. 107, and such water as the citizens of the said City shall be entitled to and shall desire to use for irrigation purposes under such by-law. (g) On the part of the City that during any period of exemption from taxation to rhich it shall be entitled hereunder, the company shall for the purpose of its business and without charge therefor, have free and un-in -terrupted access to and the use of any natural reservoir or water site the property of the City, and supplied by water from an irrigation system, and any surface or irrigation water therein contained within the City of Lethbridge. (h) Oh the part of the City, that should the Company enlarge its said mill or construct another mill so that � the said new or enlarged mill shall have a total capacity of at least 600 barrels per at hours, or should the Company during the said term of fifteen years erect a mill additional to that first above referred to. so that the original and addlt -lonal mill together shajl have a capacity of at least 600 barrels per 34 hours, then that the City will grant to the Company total exemption from taxation by the Municipality (whether in respect of municipal, school or other taxes, rates or assessments, other than local improvement taxes and local Improvement assessments) for and during en additional period of five years to commence on the St st day of December. 1099 and to. determine on the aist day ol December, 1927.
