argu ments whether it is or is not a gambling device The case is an appeal from a State Superior Court ruling that the machines are gamblingdevic es and subject to confiscation by legal authorities Atty James P McArdle argued that the machines can be used as a gambling device but also can be used for sheer amusement and therefore are not gambling devic es in themselves McArdle represented American Legion Post No 51 of Fayette County which was one of the de fendants following a state police raid in June 1957 Frank P Lawley a state deputy attorney general told the high court the machine is specifically equipped to record payoffs made by proprietors who have such ma chines in their establishments The case is one which may de cide the future of some 20 million dollars worth of multiple pinball machines that have been operat ing in Pennsylvania Many com munities in the state tax the machines heavily and if the ma chines were outlawed by supreme court action the municipal tax losses would amount to hundreds of thousands of dollars During the arguments attorneys for both sides operated the exhibit frequently turning it around so the justices could see the intricate wiring and learn the mechanics of the device Both attorneys agreed that an unlimited number of coins could be put into the machine without making a single play while play ers sought to increase the odds The
