Legal notice from Page in innocuous request such As Atchison a could zoning not be accommodated. Having expressed his reservations on the matter Johnson agreed to have the Council reconsider the request at a Public hearing conducted at the next Council meeting april 16. Most extraordinarily the rezoning request will not be reconsidered by the planning Board and zoning commission. Planning director Paul key explained a they the Board have already made their position Clear on the in keys and the planning boards opinion the precedent setting potential of a favourable ruling is not the Only pitfall. There is another Issue involved that of so called a a spot zoning. A spot zoning a key defines a is a method of creating permitting or legalizing a particular use which is not necessarily compatible with the surrounding Atchison lives in a sparsely settled residential development. All eight of his neighbors signed a petition saying they had no objection to his building a body shop in the location he had selected. He presented his petition to the planning Board in his first appearance there last july. Despite the petition and the fact that two service stations classified c-4 Are several Hundred feet Down the Road the Board Felt in Good conscience it could not recommend the request favourably. Though sympathetic to Atchison a Appeal the City Council upheld the planning Board ruling in August. Atchison filed a new petition considered by the planning Board in september where it was again recommended unfavourably. In november the City Council formally denied Atchison s request a second time. The next month just after the new members of the Council had taken office Atchison again appeared before the City Council. This time he complained about a rezoning request just granted for the establishment of a used car lot. It seemed to him that this was a Case of spot zoning and that he was therefore being treated in a discriminatory fashion. Key agrees that spot zoning May have been the result in this instance. But in keys opinion there is More than one Type of spot in the Case Given favourable attention by the Council he feels that spot zoning was desirable for the property in queston had been improperly zoned in the first place. The request was from Ernest Perkins who was operating a used car lot adjacent to a service station on Lexington Avenue. Both the station which existed prior to zoning in that area and the used car lot were in a manufacturing zone. By changing the zone to commercial key Felt that the Council would be correcting a mistake made when the zoning maps were drawn. In Atchison Scase however the City would be establishing an entirely new Enterprise in a otherwise undisturbed residential neighbourhood. Key determined that spot zoning would not be beneficial in this instance. At the same december meeting the City Council sought another solution to Atchison a problem. The Council directed key to prepare proposed regulations for consideration by the planning Board. If adopted the rules would have permitted limited business enterprises in residential neighbourhoods. Key did As he was instructed but the planning Board turned Down the proposal which key himself did not endorse. Under the proposed rules businesses would have been permitted on a conditional basis in residential neighbourhoods. When the owner of the business died however the permit allowing the business could not be transferred to his heirs. In other words the business would have to cease whatever the investment in it. Explaining his reservations about the proposal key said the one owner provision would be almost impossible to administer. By allowing the business to continue in perpetuity whoever the owner might be would have the same effect As spot zoning residential developments would suffer As a result of proliferating commercial enterprises. But Atchison who will have his Day once More before the Council is determined to have his Auto body shop. If he can to have it on his lot which until two years ago was a pasture for his horse he says he will find a site elsewhere. Man honoured for service Asheboro Luther Johnson Long time custodian for the Randolph county courthouse and a former Deputy sheriff was honoured thursday morning by Randolph county commissioners for his 40 years service to the county. Johnson who is retiring at the end of this month first worked with the county As a Road maintenance worker then a Deputy sheriff and in -i960 took Over his present Job. Maintenance supervisor.
