High Point Enterprise, The (Newspaper) - July 28, 1976, High Point, North CarolinaBy Patty is blocked los Angeles a William and Emily Harris by resting their Case without calling a witness have blocked their former underground companion Patricia Hearst from testifying against them. The move was the second major Surprise of tuesday s court sesion and it Means the harrises Fate will probably be placed in the hands of jurors by the end of the week. The harrises lawyer denied that the move was in tended to Block miss Hearst s testimony but that was its effect nevertheless. The Day s first big Surprise was a prosecution announce ment that miss Hearst would turn state s evidence against her former fugitive travelling companions. She is a co defendant with them on kidnapping robbery and assault charges but will be tried separately. The prosecutor said miss Hearst already convicted in a san Francisco Bank robbery Case had offered to testify without immunity and that he planned to Call her As a rebuttal witness. But minutes after the prosecution rested. Harris Rose to Tell the jury in Light of the state of the prosecution Case and in Light of the court s rulings. I will present no opening statement and i rest my like Bill i do the mrs. Harris said. I rest my both defendants glanced toward the rear of the courtroom where Harris parents and sister Sal. Leonard Yves Glass the chief defense attorney told reporters later that the prosecution Case was too weak to answer and that the harrises strategy was not determined by the possibility that miss Hearst would appear. Our View of the Case is that we be been winning it while the prosecution presented he said. There was nothing More for Bill and Emily to add. Patricia Hearst As a rebuttal witness probably would have helped he said jurors might not believe her because they would remember testimony that she fired a machine gun outside a sporting goods store after Harris ran into trouble Over a shoplifting on May 16, 1974. She and the harrises were allegedly try ing to flee at the time and it was in their attempts to escape that two cars were allegedly commandeered and the two alleged kidnappings took place. Seeing the person who fired the weapon talking against her comrades whom j she almost shot would not be a very pleasant or acceptable sight for the Weinglass said. Prosecution witnesses said miss Hearst fired so wildly she could have hit anyone including the harrises.
