Penney department store Chain the North Carolina court of appeals has brought regulation of debt collection methods under the state s consumer Protection Law. The court overruled a decision by Superior court judge James h. Pou Bailey that debt collection practices Are not covered by the Law. The state department of Justice had brought action against the company claiming that Penney s had made repeated abusive threatening and harassing Telephone Calls to customers who were late paying their Bills and that the com Pany telephoned employers of such customers. The company denied the truth of the charges. In its ruling the court directed the Wake county Superior court to Issue a preliminary injunction prohibiting the company from using unfair debt collection practices. The appeals court said that since there is ample evidence that the con duct alleged did occur and the conduct complained of does fall within the scope prohibited by the consumer Protection Law it was error for Bailey not to Grant the preliminary injunction.
