In a motion filed with the u. S. District court in Raleigh the Justice department charged that the school districts have no realistic prospects of converting these Public schools districts to systems of unitary Public education required by Federal named in the department s court papers were the following districts Burlington City Bladen county Edgecombe county Holsboro City Guilford county Maxton City Raleigh City Rocky Mountain City Tarboro City and Union county. The districts have 167 Public schools that were attended by White and Black students during the 1969-70 school year the Justice department said atty. Gen. John n. Mitchell said the department s intervention was in response to an invitation by District judge Algernon l. Butler to join the Case. The original suit was filed by the Legal defense fund of the National association for the advancement of coloured people on behalf of Black children attending the schools.
