J., dec. 7 the new Jersey supreme court today banned distribution of the King James version of the new testament to children in the state s Public schools. The court said the new Testa ment was a sectarian Book and distribution of it through the Public school system would violate the United states and new Jersey constitutions. Our decision in this Case must be based upon the undoubted Doc Trine of both the Federal Constitution and our new Jersey Constitution that the state or any instrumentality thereof cannot under any circumstances show a prefer ence for one religion Over another. Such favouritism cannot be Toler ated and must be disapproved a a Clear violation of the Bill of rights of. Our the court said. A 20-Page decision Drew unanimous approval of the seven Mem Ber court. The Case is based on a 195 Resolution by the Rutherford Board of education to permit distribution of the King James version of the new testament and the books o psalms and proverbs from the old testament to those Childre whose parents requested it. The distribution was to take place at school. The books were to be supplied by the Gideons International s Ion profit association incorporated under the Laws of Illinois. The is known for its Gideon Bible found in hotel Ooms throughout the undertaken a National program of distributing the books to Public school children. The Case was instituted As a court test of the program. A jewish Parent. Bernard Tudor and a Catholic Ralph Lecoque obtained an injunction in Early 1952 forbidding distribution of the books. Both claimed the King James version of the new Testa ment was contrary to the tenets of their religions. Lecoque later withdrew his child from Public school in effect drop Ping out of the Case but Tudor sought a ruling that the Board of education s Resolution was unconstitutional.
