If i supposed the Treasury note Bill to be unconstitutional my hand should fall withered at my Side before i would vote for these resolutions. But sir i do not believe that Congress would exceed its just Powers in enacting this measure into a Law. They have very forcibly declaimed against unconstitutional measures but have thus far spared them selves the trouble of proving that this measure a such a one. But among these there is no prohibition relating to what shall to made a tender in payment of since the framers of the Constitution thought this prohibition one of sufficient import Ance to be expressly imposed on the and since they thought it necessary in the same connection to insert several prohibitions of Power upon of them of less importance than is no Way to account for their omitting this prohibition of Power to Congress except upon the hypothesis they did not in tend any such prohibition. They doubt less thought it Wise that the Power to make something else than Gold and Silver a should be left with the fed eral government to be exercised at times of great National necessity. Indeed i will now show that they Hod in a pre ceding Section delegated this very Power to Congress. I have Long maintained that sound and excellent theory of the Constitution which teaches that the Federal government is one of limited the Powers not delegated to it by the Constitution nor prohibited to the states Are reserved to states or the people. The Powers of Congress then Are All delegated Powers. But All Are i agreed that these Are of two express and implied and i contend that the Power to make these demand nates a ii an implied Power. In the eighth Section of the first article of the Constitution Power is expressly delegated to Congress to to raise and support to provide a and to make All Laws which shall be necessary and proper for carrying into execution the foregoing an insurrection of fearful magnitude to Day threatens the Constitution and the capital. Congress has Power to suppress this insurrection. To this end it has Power to main Tain great fleets and to the of Gantic proportions of the evil to been countered. But to maintain these con Gress must Hare vast sums of Money. When Gold and Silver cannot be obtained in sufficient amount a substitute must be provided. It is necessary to the Success of the government in its great struggle that this substitute should be made by legislation As nearly equal in value to Coin As possible.
