police detective Lynda Henson was among detectives who detained photographer Benigno Garcia for about an hour thursday afternoon to get negatives of pictures Garcia took for a san Angelo attorney by Gloria Martinez news Herald writer a Del Rio news Herald photographer was detained by detectives for an hour thursday after noon because he would not surrender negatives of photographs he took of evidence introduced into Federal court against a former police officer the photographer remained in police custody after the detectives failed to produce a warrant for his arrest or a search warrant the evidence photographed was a matter of Public record available to anyone wishing to review it photographer Benigno Garcia said he went to Ross drug store at Plaza Del sol mall thursday to pick up the negatives to be used by an attorney in a pending lawsuit against former Del Rio police department patrolman Fernando Rudy Chris Ybarra Ybarra was sentenced last december to life in prison after being convicted in Federal court Here in september 1982 of a civil rights violation in connection with the slaying of 21yearold Dora Elia quiz Martinez he was scheduled to stand trial in Kerrville on a state murder charge stemming from mrs Martinez death but his Case was dropped after Mak ing a plea bargain arrangement with District at Torney Tom Lee Garcia had been employed by Robert Junell a san Angelo attorney who is representing is Martinez family Junell had hired Garcia to take Pic Tures of photographs submitted As evidence in court concerning is Martinez death Garcia said the negatives were sent by the Del Rio Ross drug store to Eagle pass drug store for processing he said he went to pick up the negatives after the photo department at the Eagle pass store refused to print copies of the pictures when Maverick county District attorney Rudy p Rodriguez saw the pictures at the store while there on private business Lee said Rodriguez was familiar with the Martinez Case and asked the employee How the Pic Tures which were marked police appeared at the store Rodriguez contacted Del Rio police after the employee told him the pictures were submitted by Garcia for processing Polo Ortiz a photo lab employee at the Eagle pass store said employees at the store were told Cox Castillo Garcia by a supervisor to tear the pictures after Rodriguez inquiry it is not known who gave the orders that the photos be destroyed when he arrived at the Del Rio store Garcia said he was approached by police detective Lynda Henson who said she had orders to take the negatives from him she told me Ive got orders to take the negatives away from you you cant leave until you give me the Garcia said he said mrs Henson told him detective Ramiro Castillo and assistant District attorney Leonard Cox were in the process of getting a search War rant but he said mrs Henson had no warrant to confiscate the pictures when making her request after refusing to turn Over the negatives Garcia said he waited inside the mall for Castillo and Coxs return with mrs Henson and another patrolman who was called to the scene during that time Garcia called Del Rio news Herald publisher Fritz Wirt who then contacted District attorney Tom Lee who said he knew nothing about the warrant Lee began his investigation into the incident and subsequently Learned through Cox and Castillo that police officials were concerned that the negatives Garcia had were different from those submitted in court the police department simply could not figure out Why photos taken in a criminal investigation were not in the county officials thursday refused an offer by the government to Purchase an auxiliary station maintained in Eagle pass by Laughlin air Force base for Pilot training however the officials agreed to continue joint usage of the auxiliary station until government officials can find an alternate location for the facility during a meeting called by Laughlin Wing commander col Albert a Gagliardi Maverick county commissioners court said economic conditions in the county and the need for new air port facilities were prohibiting them from Selling the Maverick county radar base Airfield were going through some trying Maverick county judge Rudy Bowles said there is an urgent need to have Airport facilities to compete in Industrial the government had offered to Purchase the property for million the property known As the Poorboy auxiliary station includes 646 acres of pro Perty 12 Miles North of Eagle pass that presently is leased from Maverick county by the government for Laughlin
