Daily Kennebec Journal (Newspaper) - December 8, 1904, Kennebec, MaineDaily Kennebec journal i. December a 1904. Meta Bush whatever we to Baksai of Werr Atlon or return to Jet std to Why twelve a jury once More to new York they Are struggling with the difficult problem of selecting 12 men without Bias or prejudice to decide whether fan Pat tenon the actress killed her Lover Ceasar Young the Gambler ast Jane. The trial was began Severa. Weeks atom and after the Proe edition bad presented the larger part of its eve Dence one of the jurors was suddenly so Reg do. Coup. Augusta. Mate. A state without a capital. As the election returns come to from the far West the interesting fact is Learned that in Wyoming the election of a president was by of Means the Only important matter under consideration. It seems that that state contrary to the common opinion outside its Borders has no permanent capital and an attempt was made to select one. Most of us have implicitly believed the statement of the geographies and other books of Cheyenne is the capital of Wyoming and so it is for temporary purposes but not for All time. The wine framers of the Wyoming Constitution decided that while Chey Enne was All right As a temporary Cap ital. It was quite probable that within a few years some Young Metropolis would soon Spring up More deserving the Honor accordingly these prophetic Constitution makers set the year of Grace 1904 As the time when the state should give up boarding and lodging at Cheyenne and move into a permanent Home of its own. According to this provision of the Constitution the vote for the capital was held november 8, and it was n Day of rustling and heart burnings throughout Wyoming. Cheyenne the biggest place in the state wished to be made the Perma nent capital but some half dozen other cities were Active aspirants for the Honor. When the votes were counted it was found that Cheyenne had 733, Lander Casper 3.586 and Rock Springs 417. With 141 votes scattered among other towns. Lander which pushed Cheyenne hard has at present Over 1000 votes to be made the permanent capital and As the Constitution does not provide for a second election the matter is still unsettled. In the meantime Cheyenne remains the temporary capital until the Constitution la amended and Lander Casnet and Rock Springs each has Faith that by the time that is done its claims will be recognized As Superior to those of Cheyenne. Possibly a Compromise will be Mode by which the towns in question will each be made the temporary capital for a term of years. Unless there is some such Compromise it is not unlikely that Wyoming will Al ways be without a permanent seat of government and have a capital elec Tion As w regular source of excitement when Campaign comes around. The government figures for the cot ton crop Are Good news to the Nev England Mill owners who must get their raw material More cheaply in or Der to keep on doing business. The crop will reach a total of almost 13. Bales the largest Ever raised in the South. The ravages of the Boll Weevil were much exaggerated and it is to be hoped that the speculators win be equally unsuccessful in their rav Ages upon the crop. In spite of Descom future at the result of the National election the South has reason to be Happy these times and the whole country rejoices ovei1 the record breaking Cotton crop. Probably King vector Emmanuel of Italy does not pose As a humorist but it in difficult to see Why he selected the order of St. Lazarus As the one to be conferred up 3. Pierpont Morgan in re turn or the latter s interest in italian Art. Lazarus was it poor beggar who gathered up the crumbs from the Rich Man s table and or. Mori an does not figure prominently to that kurd of a role. About More people visited exposition in ism than at tended the big show louts this went for nothing and now they Are attempting of begin All Over again. Such an occurrence to trial which is attracting so much Public attention brings up the question which Jas often been raised before namely Why Laws should not be so amended that in the Case of ill fees or death or unavoidable absence of a juror during a trial the Case May proceed with 11 jurors. In some of the states Maryland for instance such a Law prevails in cases but it does not apply to criminal procedure. The present Rigac require ment of 12 men throughout a trial often works hardship upon the prisoner As in the present instant and of course causes the expense of the trial to be greatly increased. There is no Peculiar sacredness to the number 12, except that it happened to be selected in the common Law countries As the proper number and the Law clings so closely to its old and workout traditions that it is next to impossible to get anything of this kind changed. No right of state or prisoner would a sacrificed if such a trial should continue with 11 jurors instead of 12. It would be a simple matter to Aarend the Laws of the various in this respect and the result be a great saving of time and expense in Many cases but it is almost too much to Hope that such a thing we soon be done. I we have spoken of three Congress Mer elect from the City of Chicago All the age of 30 years but Accord ing to the latest report that has come eastward. It is not one of these but still another Illinois Republican who will have the Honor of being the Man in the next Congress. Congressman elect Rives of an i Lundus Rural District is said to be Ess than 24 years of age. Since the Constitution requires that a member shall Lave attained the of 25, a. Rives will have to hurry some to get inside the limit before the 59th Congress Assem Bles a year hence. There is every indication according to the new York papers tha when the new York legislature meets this whiter to elect a United states senator to succeed senator Depew the number of Maine born men sitting in the upper Branch of Congress will be increased by one. Sex governor Black seems to be the Man slated As or. Depew s Suc Cessor and is undoubtedly splendidly qualified for the High position. He is a Strong Man with a clean ecord and is one of the most eloquent pubic speakers in the United states. Not even Bryan in the face of Parker s overwhelming de eat maintained a More cheerful spirit than has governor Bates of Massachusetts since the landslide which gave Douglas v c tory Over him. His a Ter dinner speeches since the election have bub Bird and sparkled with jokes at his own expense and he has Aow Efi greatly to the esteem in which he is held by the Massachusetts people through the philosophic and cheerful manner in which be took his defeat. The new governor general of Canada has not Salt anything about his ideas on the race suicide Yie Ory but his prophecy that Canada will have a population of to Dve years shows that he is not worrying much about the Canadian fathers and Moth ers. The woman and the rib. Adam gave is rib to make a woman s shape thus the Story s writ there is no Many an Arctic whale witless of the blame. The storm Clouds Are gathering thickly Over the Summit of Shiloh. A workshop for every jail in the state is the mandate of the inspectors and the heart of the Hobo is heavy with woe. Anyway the republicans carried andr Scoggin and Knox at the National election by pluralities of 2200 and 700 respectively. The Texas returns show almost As Many republicans in that state As in Maine but not quite so Many to the Square mile. The Houlton band boys Are discouraged and will give up the organization. The Aroostook Metropolis evidently does not appreciate music. Here is a Story told by a Lewiston teacher. She had told the children to bring in stories on special subjects. To one Little Chap she said you Johnny May bring one to with a bit Ter the next morning when Johnny read his Story. It was some thing to this effect. There was a cat and dog was neighbors. The dog used to Chase the cat. One Day the cat run and the dog after her. At last she Clim a Fence and the dog Only Jitter end " the coming meeting of the state Encampment of the grand army of Maine to be mid in Lewiston in february is a topic of interest with the veterans now. The chief topic is who will be the next commander of the department of Maine. Hon. F. O. Beal of Bangor was mentioned before the Encampment last year but he declined to allow his name to be used. It is presumed that the fight will be Between capt. Henry o. Perry of fort pair Fifeld and Frederick s. Walls of Vinalhaven the two unsuccessful candidates of last year. Not Long ago miss Charlotte Thomas one of Portland s Public spirited women was conducting a Public meeting at which there was a Large attendance. It became her duty to introduce a visiting speaker a gentleman. As he begot to talk miss Thomas who is somewhat hard of hearing several times urged him to speak louder and soon the whole Assembly was thrown into convulsions of laughter. The cause of this mirth was the fact that the gentleman was then sounding the praises of miss Thomas herself and every time that she called for him to speak louder it made the situation the More ridiculous it is needless to say that when the facts were made to miss Thomas later that she too appreciated the although somewhat chagrined. Dorothy is a Massachusetts Inland girl aged seven and came to Portland to visit a Little Cousin. One afternoon she was entertained in a trolley ride Over to the Cape with a Promise that she should see the sea which of course was considered a great treat. As the car rolled Over Portland Bridge her attention was called to the water with the remark that it was the sea Al before she had a Good look the car was across the Bridge and again on Terra Florma. Or. Lewald said "1 fully share the standpoint of pres. Francis of the exposition. In the act of Congress it is stated expressly that the exposition shall be International in character and the rules and regulations state explicitly that the jury Shah be International. In Accord foreign nations have been members of the group jury the department jury the Superior jury and the committee of five. It should therefore be irreconcilable with the International character of the exposition were a corporation of the National committee or the exposition co which Are not International corporations in any Way to interfere with the distribution of the awards. There is no doubt that the Imperial government of Germany would never have permitted Germany s participation in the Competition had there been the slightest possibility that the findings of the International jury could be changed by and corporation that was not an International the experiences of the Bellevue Hospital ambulance surgeons in the unlighted districts skirting East River where it is not Safe even for policemen to venture sometimes have led the hos Pital authorities to equip the instrument bags carried by the surgeons with a tubular electric dark lantern sixteen inches Long and two inches thick weighing about two pounds.
